As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
Includes only 100% aluminum beverage containers.
COMMINGLED
Includes all aluminum cans, glass, tin/steel cans and plastic containers.
CONSTRUCTION AND DEMOLITION DEBRIS
"Construction and demolition debris" shall mean source-separated, nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within the Village of Ridgewood. This material shall include concrete, bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles, trees (including stumps, branches and shrubbery), recyclable wood scrap and any and all other material generated from the construction, alteration, repair, maintenance, and/or demolition of a structure or structures within the Village of Ridgewood which are deemed recyclable.

CORRUGATED CARDBOARD
Includes cardboard of the type used to make cardboard boxes, cartons, pasteboard and similar corrugated and kraft paper (brown paper bags) material.
FERROUS, NONFERROUS METALS AND WHITE GOODS
Domestic or household bulk items, such as washing machines, refrigerators, stoves, dryers, air conditioners, metal household appliances, and includes any other ferrous or nonferrous metals. Expressly excluded, however, are automobile mufflers, catalytic converters, and automobile parts containing oil, fluids or gasoline.
GLASS
All products made from silica or sand, soda ash and limestone which are transparent or translucent and used for packaging or bottling of various matter, and all other materials commonly known as "glass," excluding, however, light bulbs, blue glass, plate and flat glass commonly known as "window glass," drinking glasses and mirrored glass.[1]
HOUSEHOLD BATTERIES
Any type of button, coin, cylindrical, rectangular or other shaped enclosed device or sealed container consisting of a combination of two or more voltaic or galvanic cells, electrically connected to produce electric energy, composed of lead, lithium, manganese, mercury, mercuric oxide, silver oxide, cadmium, zinc, copper or other metals or any combination thereof, and designed for household use, including any alkaline, manganese, lithium, mercuric oxide, silver oxide, zinc-air or zinc-carbon battery, nickel-cadmium rechargeable battery or sealed lead rechargeable battery.[2]

MIXED PAPER
All periodicals and catalogs printed on glossy stock or paper of heavier quality than that commonly recognized as newsprint; high-grade paper, nonnewsprint inserts from newspapers, materials received in the mail which are made of paper, specifically including catalogs, color inserts, magazines, brochures and other magazine-type mail printed on paper of heavier quality than that commonly recognized as newsprint. The term "high-grade paper" as used herein shall include computer printout, ledger and bond paper, such as is used in copy machines, typing and carbonless forms. Expressly excluded, however, are newsprint, corrugated cardboard, kraft paper and carbon paper.

PLASTIC CONTAINERS
Polyethylene terephthalate (PETE) and high-density polyethylene (HDPE) containers used in the packaging of potables, such as soda, milk, juices, drinks and water. Expressly excluded, however, are bleach, oil, antifreeze, detergent and other plastic containers with chemical residue.
RECYCLING CONTAINERS
Containers provided by the Village for the purpose of recycling or other containers expressly approved by the Village Manager for the purpose of placement of recyclables or vegetative waste for pickup by the Village.
REGULATIONS
Such rules, implementation dates, schedule times and such other requirements promulgated by the Village Manager as may be necessary to carry out the purposes and objective of this article.
TIN/STEEL CANS
Includes 100% tin/steel household cans and bimetal beverage containers. Expressly excluded, however, are paint cans and cans containing chemical residue.
USED NEWSPAPER/NEWSPRINT
Includes all paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Nonnewsprint inserts shall be removed and recycled along with mixed papers.

VEGETATIVE WASTE
Includes leaves, grass clippings, brush and vegetative matter not exceeding four inches in diameter and/or over four feet in length.

All persons who are owners, lessees or occupants of residential or institutional property, places of worship, schools and commercial property in the Village shall separate used newspaper/newsprint, mixed paper, corrugated cardboard, tin/steel cans, aluminum cans, glass, plastic containers, white goods, vegetative waste, ferrous and nonferrous metals, and construction and demolition debris from any other trash and garbage produced from any such residences, institutions, schools, places of worship and commercial property and shall prepare the same for pickup, collection and recycling in accordance with all applicable regulations. Physically disabled individuals shall contact the Recycling Coordinator for assistance.

A. 
Used newspaper/newsprint and mixed paper. All used newspaper/newsprint shall be separated from mixed papers, corrugated cardboard and kraft bags and placed in the Village's newsprint crate or secured by twine in separate bundles not to exceed 12 inches in height. All mixed paper shall be separated from newspaper/newsprint, corrugated cardboard and kraft bags and placed in the Village's mixed papers crate or secured by twine in separate bundles not to exceed 12 inches in height. Such bundles shall not be contained in plastic bags or paper bags. Used newspaper/newsprint and mixed paper shall be placed at curbside in separate bundles for pickup, collection and recycling in strict conformity with regulations promulgated by the Village Manager.

B. 
White goods, ferrous and nonferrous metals. White goods, ferrous and nonferrous metals shall be separated and placed at curbside for collection by the Village in accord with regulations to be promulgated by the Village Manager.
C. 
Glass, aluminum cans, tin/steel cans and plastic containers. Glass containers, aluminum cans, tin/steel cans and plastic containers shall be combined in recycling containers approved by the Village and placed at curbside for collection by the Village in accord with regulations to be promulgated by the Village Manager. All materials must be washed or rinsed.
D. 
Corrugated cardboard. Corrugated or cardboard boxes and kraft (brown) paper bags shall be placed at curbside in accord with regulations to be promulgated by the Village Manager. Such materials must be free of trash, foam, plastic or packing materials.
E. 
Household batteries. Household batteries shall be delivered to the recycling center or to one of the Bergen County Utilities Authority-sponsored household hazardous waste collection programs.
F. 
Construction and demolition debris. Construction and demolition debris shall be separated and disposed of by private contractor, commercial recycler, or property owner. Upon acquiring the necessary Uniform Construction Code permit(s) for construction or demolition, it shall be the responsibility of the permit holder, owner, occupant or lessee of said property to recycle said materials as defined in § 165-39, Definitions. All subsequent records, and or weight slips documenting the recycling of said materials shall be given to the Village of Ridgewood Municipal Recycling Coordinator before a certificate of occupancy can be issued.

Effective November 15, 1990, it shall be mandatory for all owners, lessees and occupants of garden apartment, condominium, cooperative and townhouse residential properties to comply with all the requirements contained in this article. It shall be the obligation of the owner of the apartment complex or the condominium/cooperative/townhouse association to provide an on-site storage and collection point for the recyclable materials. The Recycling Coordinator and the owner/association representative shall determine a schedule and method for the collection of materials.
The Village Manager shall promulgate reasonable regulations establishing the commencement dates for mandatory separation of recyclables and the manner, dates and times for the collection of the same or delivery of the same to a recycling center or drop-off center. Any such regulations promulgated by the Village Manager may be changed, modified, repealed or amended, in whole or in part. A copy of the regulations, as promulgated, shall be available for public inspection at the office of the Village Clerk during regular office hours.
From the time of placement at the curb for pickup, collection or recycling or delivery to a recycling or drop-off center, recyclables shall be the property of the Village of Ridgewood or its duly authorized agent. No person unauthorized by the Village of Ridgewood shall collect or pick up or cause to be collected or picked up any such recyclables. Each collection or pickup of recyclables in violation hereof from one or more residences, institutions, schools, places of worship or commercial properties shall constitute a separate and distinct offense.

No provision herein shall be construed to prohibit groups or individuals who shall be authorized by the Village Manager from collecting or picking up recyclables at curbside or otherwise in such manner and under such conditions as shall be prescribed by the Village Manager. No such collection or pickup shall conflict or interfere with pickup and collection by the Village and its duly authorized agent. Any collection or pickup made by groups or individuals authorized by the Village Manager shall require that the tonnage of the pickup be recorded and reported to the Village Manager.
Recyclables or vegetative waste shall not be placed at the curb prior to 5:00 p.m. on the night before scheduled collection or after 6:00 a.m. on the date of scheduled collection. By 12:00 midnight on the day of collection, all containers must be removed from the curbside.
The enforcement of the provisions of this article shall be the responsibility of the Recycling Coordinator, the Sanitation Enforcement Officer and any officer duly appointed by the Village Manager.

Any person, firm, or corporation who violates or neglects to comply with any of the provisions of this article or any rule or regulation promulgated pursuant thereto shall be subject to punishment in accord with Chapter 1, General Provisions, Article I, of the Ridgewood Village Code, with the exception that there is established hereunder a minimum fine of $25 for any violation of this article or any regulation promulgated pursuant thereto, and a maximum fine of $1,000, except for construction and demolition debris. In the matter of construction and demolition debris recycling, failure to recycle said materials as defined in § 165-39, Definitions, will result in a minimum fine of $1,000.
