Each user of wastewater collection and treatment
services provided by the Village of Ridgewood shall pay his proportionate
share of the cost of operation and maintenance (including replacement,
and further including extraneous flows such as groundwater and stormwater
which enter the system) of such works as set forth in this article
as follows:
A. Residential users and small nonresidential users with
waste flows of no more than one equivalent dwelling unit (EDU) of
domestic sanitary wastewater shall continue to pay for their use of
the system based on ad valorem taxation.
B. Industrial, institutional, and commercial users which
discharge more than one equivalent dwelling unit (EDU) of flow shall
pay for their use of the system based on the annual volume discharged,
in addition to parameters such as biochemical oxygen demand (BOD),
suspended solids (SS), chemical oxygen demand (COD), and the quantity
of fats, oils and greases per unit volume of the flow.
C. Tax exempt and tax credited users, including users
who make a payment in lieu of taxes but excluding municipally owned
properties of the Village of Ridgewood, shall pay for their actual
use of the sanitary sewage collection system as determined by taking
the total metered water consumption (in gallons) during the fourth
quarter and first quarter of a year (the months October, November,
December, January, February and March) and doubling it as equal to
actual annual water consumption for the calendar year. The flow charge
shall be per 1,000 gallons discharged, as determined by the provisions
of this chapter.
The user charge system shall be reviewed biennially
to assure that all users are paying their proper proportionate share
of the cost of the operation and maintenance of the system and otherwise
to comply with the rules and regulations now or hereafter promulgated
by the Environmental Protection Agency.
Any increased cost which may result to the system
because of toxic pollutants discharged into the system shall be paid
entirely by the toxic discharger responsible therefor.
Each user of the system shall be notified at
least annually of the rate and portion of overall taxes paid attributable
to the wastewater collection and treatment service system.
A system of costs and payments set forth in
this article shall take precedence over any preexisting agreement
or contract which terms are inconsistent with the aforementioned Act
and regulations enacted pursuant thereto.
In the event that a pretreatment program is
required to be installed by the Village, the costs of such a pretreatment
program shall be included in the user charge system cost.
The Village Manager is hereby directed to develop
and implement a detailed system of recordkeeping for wastewater flows
and user rates for each user class, to prepare and issue separate
billings or notification to indicate sewer user rates and charges
for each class herein established and to implement a detailed recordkeeping
system for bills issued and payments received based on the sewer user
charge system.

A. The annual service charge rates for the different
user classes for the current fiscal year, and subsequent years, shall
be determined by the Village Council of the Village of Ridgewood.
B. The significant discharger annual flow charge rate
shall be per 1,000 gallons discharged, in excess of one EDU per year,
as determined each fiscal year by the Village Council of the Village
of Ridgewood based upon the operating costs of the Village of Ridgewood
Water Pollution Control Facility.

All dischargers to the Village of Ridgewood sanitary sewer collection system that are classified as tax exempt or tax credited users shall pay for their wastewater discharge. The rate charged shall be in accordance with the provisions of §
238-59C.
