There is hereby created a commission known as
the "Shade Tree Commission of the Borough of Rockaway."

The Shade Tree Commission established by this chapter shall consist of five members, appointed by the Mayor and shall serve without compensation except as otherwise provided in § 77-4.
The first Shade Tree Commissioners shall be
appointed within 60 days after July 8, 1965, and their terms of office
shall commence upon the day of their appointment and be for the respective
periods of one, two, three, four and five years, beginning on the
first day of January next succeeding such appointment. The term of
each appointee shall be designated in his appointment. All subsequent
appointments, except to fill vacancies, shall be for the full term
of five years, to take effect on the first day of January.
A.
The Shade Tree Commission shall organize annually
for the election of one of its members as Chairman and the appointment
of a Secretary, who need not be a member.
B.
The salary of the Secretary, who may be compensated
even if a member, shall be fixed by the Council. The salary of all
other employees of the Commission shall be fixed by the Commission.
All salaries shall be fixed as nearly as practicable in accordance
with the salary schedule of the Borough for corresponding positions.[1]
A.
The Shade Tree Commission shall have the powers provided
by N.J.S.A. 40:64-5.
B.
The regulation, planting, care and control of shade
and ornamental trees and shrubbery upon and in the streets, highways
and public places, parks and parkways within the Borough, except state
highways, unless the State Highway Department shall assent thereto,
and except county highways, parks and parkways, unless the County
Shade Tree Commission shall assent thereto, shall be exercised by
and be under the authority of the Shade Tree Commission.
