A.
The owner or tenant of lands abutting or bordering
upon the sidewalks and gutters in the public streets of the Borough
shall remove all weeds and other impediments therefrom for a distance
of three feet laterally on both sides of said sidewalks within seven
days after written notice to remove the same.
B.
Written notice directing the removal of weeds and
other impediments shall be given by or under the direction of the
Borough Clerk, the head of the Police Department or the Health Officer
and shall identify the lands abutting or bordering upon the sidewalks
and curbs as hereinbefore provided and shall contain a short statement
relating in detail and identifying the weeds or other impediments
which are directed to be removed. The notice shall also contain a
statement that the violation of the terms of this section is punishable
by fine or imprisonment, or both.
C.
The notice may be served upon the owner or resident
in the Borough in person or by leaving the same at the owner's or
resident's house or place of residence with a member of his family
above the age of 14 years. In case any such owner shall not reside
in the Borough, such notice may be served upon him personally or mailed
to his last known post office address, or it may be served upon the
occupant of the property or upon the agent of the owner in charge
thereof.
A.
The owner or tenant of lands lying within the Borough
shall keep all brush, hedges and other plant life, signs, walls, fences
or other objects or obstructions growing or located within 10 feet
of any roadway within the Borough and within 25 feet of the intersection
of two roadways within the Borough cut, removed or altered to a height
of not more than 2 1/2 feet where, within the discretion of the
Chief of Police of the Borough, it shall be necessary and expedient
for the preservation of the public safety, within 10 days after notice,
to cut, remove or alter the same and to provide for the cutting, removal
or alteration of the same, but should any owner or tenant as aforesaid,
after notice to cut, remove or alter the same, fail, refuse or neglect
to do so, the same may be cut, removed or altered under the direction
of the Chief of Police of the Borough.
B.
In any case where brush, hedges, other plant life,
signs, walls, fences or other objects are cut or removed or altered
from any lands in the Borough under this section by or under the direction
of the Chief of Police as stated herein, the Chief shall certify the
cost thereof to the Mayor and Council, which body shall examine the
certificate and, if found correct, shall cause the cost as shown thereon
to be charged against said lands, or, in the event that such cost
is excessive, the aforesaid body shall cause the reasonable cost thereof
to be charged against said lands. The amount so charged shall forthwith
become a lien upon such lands and shall be added to and become and
form part of the taxes next to be assessed and levied upon such lands,
the same to bear interest at the same rate as other types and shall
be collected and enforced by the same officers and in the same manner
as taxes.
It shall be unlawful for any person to dig up,
take or carry away any soil, sod or dirt in, upon or from any of the
streets or public grounds of the Borough, except by and under the
supervision, order and direction of the Mayor and Council or of the
Committee on Streets, appointed by the Mayor and Council, or of the
Street Commissioner and when engaged in working and repairing the
streets and public grounds of the Borough.
