It is the intent of the Town Board in this chapter to authorize certain Town of Clarkstown personnel to issue appearance tickets to persons and businesses in violation of ordinances and local laws enacted by the Town of Clarkstown, the County of Rockland and the State of New York for the purposes of efficient and expeditious enforcement and prosecution in Justice Court and for the peace and good order of the Town of Clarkstown and its residents. In addition, the Town Board enacts this chapter for the purpose of providing for the efficient enforcement of the New York State Uniform Fire Prevention and Building Code,[1] as promulgated by the New York State Department of State, as well as all other ordinances, local laws and rules and regulations of the Town of Clarkstown, the County of Rockland and the State of New York.

The Code Enforcement personnel, inspectors and staff of the office of the Building Inspector, as designated by the Building Inspector (also known as the Chief Code Enforcement Officer); Town Attorney or designee or deputy; inspectors and staff of the Department of Engineering and Facilities Management, as designated by the Director; deputies and staff of the Clarkstown Highway Department, as designated by the Superintendent, and Animal Control Officers of the Town of Clarkstown shall have the power to issue appearance tickets as the same are defined in Article 150 of the Criminal Procedure Law.
The power and jurisdiction of the persons authorized to issue appearance tickets pursuant to this chapter include ordinances, codes and local laws enacted by the Town of Clarkstown, the County of Rockland and other New York State laws and statutes and, in the case of New-York-State-certified Code Enforcement Officials, the New York State Uniform Fire Prevention and Building Code.[1]
