By authority of this chapter, dated January 13, 1987, adopted by the Town Board, pursuant to the provisions of §§ 276 and 277 of the Town Law, as amended, for the purpose of providing for the future growth and development of the town and affording adequate facilities for the housing, transportation, distribution, comfort, convenience, safety and health and welfare of the residents, the Planning Board is hereby delegated the power and authority to review and approve, approve with modifications or disapprove plats for subdivision within the Town of Clarkstown which show lots, blocks or sites with or without new streets or highways, By the same authority, the Planning Board has the power and authority to approve the development plats already filed in the of flee of the Clerk of Rockland County if such plats are entirely or partially undeveloped.
Unless the herein requirement as specifically waived by the Planning Board (hereinafter termed "Board"), before application for a building permit within a proposed subdivision as defined herein, the applicant shall submit to the Board a plat of the property drawn in accordance with the pertinent specifications. Following the Board's review and approval and endorsement of the plat by the Chairman, the applicant shall file the approved plat with the County Clerk or Town Clerk, as specified in these regulations.
It is declared to be the policy of the Town Planning Board to consider land subdivisions as part of a plan for the orderly, efficient and economical development of the town. Land to be subdivided shall be of such character that it can be used safely for building purposes without danger to health or peril from fire, flood or other menace. Proper provision shall be made for drainage, water, sewerage and other needed improvements. The proposed streets shall compose a convenient system conforming to the Official Map, as it may be adopted and amended by the Town Board, and shall be properly related to the proposals shown on the Town Master Plan as it may be adopted and updated by the Planning Board. Streets shall be of such width, grade and location as to accommodate the prospective traffic, to afford adequate light and air and to facilitate fire protection. In proper cases, there shall be reservation of park areas of suitable location, size and character for playground or other recreational purposes.
A. 
Purposes. This chapter is adopted to assure land development and use in accordance with the policies contained in § 254-3 of this chapter and with other town laws and regulations as listed in § 254-31 of this chapter.
B. 
Requirements not covered by this chapter. Any aspects of land subdivision review not fully covered by this chapter shall be resolved by the Board, guided by the corresponding parts of the Clarkstown Site Plan Regulations and Clarkstown Zoning Ordinance.[1]

In case access to all or part of a subdivision is across land in another municipality, the Board shall obtain an opinion from the Town Attorney that access for all required purposes is insured by an authorized title insurance company and from the Town Department of Engineering and Facilities Management that such access can be adequately improved or sufficiently covered by a duly executed performance bond. Lot lines shall not cross town boundary lines or school district lines.
For a resubdivision, the same procedure, rules and regulations shall apply as for a subdivision.
