This article shall be known and may be cited as the "Firearms Ordinance of the Town of Clifton Park."
As used in this article, the following words shall have the meanings indicated:
FIREARMS
It shall be illegal within the eastern corridor of the Town of Clifton Park, defined herein as all portions of the Town of Clifton Park east of Vischer Ferry Road, Route 146A north from intersection of Routes 146 and 146A — Extended to MacElroy Road to Hatlee Road to the Town Line to discharge any 22 caliber and/or center fire rifle. In all portions of the Town of Clifton Park west of Vischer Ferry Road-Extended, twenty-two caliber rifles, other than center fire rifles, may be discharged by any individual, provided that the discharge takes place by an individual within the boundaries of his or her own property. In addition, an individual accompanied by the owner of said property may also discharge the weapon within the boundaries of the owner's property.

The provisions of this article shall not apply to the following:
A. 
Peace officers in the performance of their duty nor to any citizen when lawfully defending his person or property.
B. 
The discharge of rifles on target ranges maintained and operated by any association affiliated with the National Rifle Association or by any duly organized fish and game club, association or membership corporation.

A violation of this article and/or any of the regulations herein contained is hereby declared a misdemeanor and shall be punishable by a fine and imprisonment or, in the alternative, by a penalty of not less than $50 nor more than $500 to be recovered in a civil action commenced by the Town of Clifton Park, pursuant to the terms of this article.

The Town Board of the Town of Clifton Park hereby finds and declares that substantial risk and harm is created by the utilization of firearms within town parks and it is the intention of the Town Board to prohibit such activities.
The use of firearms within town parks and the Clifton Common is prohibited.

A violation of § 108-7 hereof is hereby declared a misdemeanor and shall be punishable by a fine of up to $250 for the first offense and up to $1,000 for every offense thereafter.
