This local law shall be known and may be cited
as "Local Law No. 9-1995 of the Town of Clifton Park, a local law
amending Local Law No. 2-1967 of the Town of Clifton Park, entitled
'Local Law Relating to Zoning for the Town of Clifton Park,' providing
for the creation of a planned development district (PDD) to be known
as 'PDD No. 38, North Country Commons.' "
Local Law No. 2-1967 of the Town of Clifton
Park, entitled "Local Law Relating to Zoning for the Town of Clifton
Park," and any and all prior amendments thereto affecting the subject
premises and the Zoning Map of the Town of Clifton Park, as set forth
therein and made a part thereof, are hereby amended by changing from
Neighborhood Business District B-1 and Land Conservation District
L-C a portion thereof, as hereinafter described, and creating within
the boundaries of said newly described area a planned development
district to be known and described as "Planned Development District
No. 38, North Country Commons." A fifty-foot buffer shall be maintained
on either side of the Dwaaskill.
The area of said Planned Development District
No. 38, North Country Commons, consists of approximately 15.75 acres
of land located southerly of New York State Route 146 and westerly
of Vischer Ferry Road (County Road No. 90) and which is bounded and
more particularly described in Exhibit "A", attached hereto and made
a part hereof.[1] Said Planned Development District No. 38 consists of one
parcel of land as set forth on the attached plan titled "Preliminary
Site Plan, North Country Commons, Proposed Planned Development District,
Prepared for Donald Littlefield," Map No. 95-15-LR, dated April 25,
1995, prepared by Ivan Zdrahal Associates.[2]
A.
The area of said Planned Development District No.
38 may be used for the following:
(1)
Sales and service of recreational vehicles,
together with all ancillary uses as may be necessary for the sales
or service thereof hereinafter shown or described.
(2)
Banks.
(3)
Restaurants.
(4)
Retail establishments.
(5)
Any other use permitted in a Neighborhood Business
District B-3 Zone.

B.
In addition, the PDD should require a 22% green area,
together with 372 parking spaces.
The following terms utilized within this Planned
Development District legislation shall have the following meanings:
An outdoor area measuring approximately 12 feet by 35 feet
used exclusively for the display of recreational vehicles. There shall
be three display pads.
An outdoor area as defined on the map used primarily for
the display of recreational vehicles offered for sale to the general
public comprising approximately 1.5 acres.
An outdoor area used primarily as a dining area for restaurant
patrons consisting of approximately 2,500 square feet.
A motorhome, travel trailer, 5th wheel, camper, pop-up, boat,
sailboat, jet ski, snowmobile, truck, van or other recreational motorized
vehicles commonly used for operation on the highway or off-road recreation.
An outdoor area used primarily for the storage of recreational
vehicles comprising approximately 1.5 acres to two acres.
Building permits for proposed establishments
within this planned development district shall be issuable upon compliance
with this legislation and upon obtainment of site plan approval from
the Town of Clifton Park Planning Board in accordance with the Town
Code of the Town of Clifton Park.
A.
Development and use of the area within the planned
development district shall be in general conformance with the attached
plan titled "Preliminary Site Plan, North Country Commons, Proposed
Planned Development District, Prepared for Donald Littlefield," Map
No. 95-15-LR, dated April 25, 1995, prepared by Ivan Zdrahal Associates.
B.
All development within the planned development district
shall be served with water supply provided through the Clifton Park
Water Authority.
C.
Wastewater flows from all development within the planned
development district shall be conveyed to improvements of the Saratoga
County Sewer District No. 1.
All improvements shall be subject to the direction
and control of a duly licensed architect and/or engineer and constructed
pursuant to plans and specifications approved by a duly licensed architect
and/or engineer and in compliance with the New York State Building
Code. The architect and/or engineer performing the work herein described
shall be employed by and at the sole expense of the developer. All
construction shall be subject to the inspection and approval of the
Town of Clifton Park Department of Building and Development.
