This local law shall be known and may be cited
as "Local Law No. 5 of 2002," providing for the creation of a planned
unit development district to be known as “Van Patten Golf Course
Planned Unit Development District.”

Local Law No. 5 of 2002, entitled "Van Patten
Golf Course Planned Unit Development District," and further amending
Local Law No. 10 of 1996 of the Town of Clifton Park entitled "Local
Law relating to the Zoning for the Town of Clifton Park and the Zoning
Map of Clifton Park," as set forth therein and made a part thereof,
be and the same is hereby amended, by changing from Residential R-1
a portion thereof, constituting approximately 317± acres, as
hereinafter described in Exhibit A,[1] attached hereto and made a part hereof, designating and
creating the boundaries of such newly described area as a planned
unit development district to be known as "Van Patten Golf Course Planned
Unit Development District," with the remaining lands identified on
said map, and particularly Lots 2, 3, 4 and 5, remaining outside of
the boundaries of the planned unit development district. Lots 2, 4
and 5 shall continue to be zoned as Residential R-1, and Lot 3 will
be zoned as B-3.

The area of said Van Patten Golf Course Planned
Unit Development District consists of approximately 317± acres
located to the north of State Route 146A, to the west of Main Street
(County Route 82) and bounded and described specifically on Exhibit
A, attached hereto and made a part hereof.[1] Reference herein to State Route 146A and to Main Street
(County Route 82) is intended for general location purposes only and
is not intended to imply that all lands along Route 146A or along
Main Street (County Route 82) are within the planned unit development
district, the exact boundaries of which are set forth in the attached
Exhibit A.

A.
The development of the Van Patten Golf Course Planned
Unit Development District has been presented and is described according
to a sketch plan filed with the Town Planning Board of the Town of
Clifton Park. This sketch may be changed, altered or amended by approval
of the Planning Board.
B.
Lot 1 will consist of multi-use recreational facilities,
including a twenty-seven-hole golf course with clubhouse, banquet
facilities, pro shop, maintenance building and storage buildings,
outdoor pavilion, driving range, gazebo, concession stand, accessory
buildings and parking facilities.

C.
The following restrictions shall apply to this project:
(1)
The emergency road must be gated.
(2)
No golf course sign shall be allowed in the
Historic District.
(3)
The emergency road will not be used as an entrance
to the golf course.
(4)
The emergency road will be used as a residential
driveway and for emergencies only, and no other kind of vehicles or
machinery or equipment, except as necessary for upgrade, repair and
maintenance of the road, shall be allowed to use the road except in
an emergency situation.

The emergency access road as presented must
be approved by ESAB and regularly maintained to its satisfaction.
(6)
The golf course entrance needs to be maintained
year round by the property owner of the PUD.
(7)
A sign shall be maintained at the gate to the
emergency road reading "Emergency Road, Authorized Vehicles Only."
(8)
Pavilion hours of operation shall terminate
by 9:30 p.m. on weekdays and Sundays and by 11:00 p.m. on Friday and
Saturday evenings.
Water is and will be supplied through and serviced
by the Clifton Park Water Authority. The sewer system is to be serviced
through the Saratoga County Sewer District No. 1.
Before any construction within the planned unit
development district is commenced or any building permit relating
thereto is issued, final site plans and specifications shall be submitted
to the Town Planning Board for its approval and shall be approved
by the Town Planning Board. Such final plans and specifications shall
be filed with the Town Clerk and the Planning Board, after approval
thereof by the Town Planning Board.
All improvements shall be designed and constructed
pursuant to the plans and specifications approved by a duly licensed
architect or engineer and in full compliance with the New York State
Uniform Fire Prevention and Building Code and the Code of the Town
of Clifton Park. The plans and specifications shall be approved by
the Planning Board, and following such approval by the Town Planning
Board, such plans shall be filed in accordance with the law. The architect
or engineer performing the work herein shall be employed by and at
the sole expense of the developer. All construction shall be subject
to the inspection and approval of the Town of Clifton Park Building
Inspector.
Local Law No. 10 of 1996, entitled "Zoning Code
of the Town of Clifton Park," is hereby amended by providing that
said Van Patten Golf Course Planned Unit Development District be set
forth on the Town Zoning Map.
