[Adopted 4-4-2005 by L.L. 2-2005]
This article shall be known and may be cited as "Local Law No. 2 of 2005," providing for the creation of a planned unit development district to be known as the "Clifton Park-Halfmoon Public Library Planned Unit Development District."
Local Law No. 2 of 2005, entitled "Clifton Park-Halfmoon Public Library Planned Unit Development District," is hereby enacted, further amending Local Law No. 10 of 1996 of the Town of Clifton Park entitled "Local Law Relating to the Zoning for the Town of Clifton Park" and the Zoning Map of Clifton Park as set forth therein and made a part thereof, by changing from R-1 Residential the land constituting approximately 10.62 +/- acres, as hereinafter described in Schedule A,[1] attached hereto and made a part hereof, designating and creating the boundaries of such newly described area as a planned unit development district to be known as the "Clifton Park-Halfmoon Public Library Planned Unit Development District."

The area of said Clifton Park-Halfmoon Public Library Planned Unit Development District consists of approximately 10.62 +/- acres located to the east of Moe Road approximately 500 feet north of Clifton Park Center Road, bounded to the west by Moe Road, to the north by lands now or formerly owned by Sandra Towers, to the east by lands of the Shenendehowa Central School District, to the southeast by lands now or formerly owned by Thomas Boykin and Donna Johnson, and to the southwest by lands now or formerly owned by Timothy and Eileen Mendoza, as more particularly shown in Exhibit B.[1] Reference herein to Moe Road is intended for general location purposes only and is not intended to imply that all lands on Moe Road are within the planned unit district, the exact boundaries of which are set forth in Schedule A and Exhibit B, incorporated herein by reference.

A. 
The development of the Clifton Park-Halfmoon Public Library Planned Unit Development District has been presented and is described according to the sketch filed with the Town Planning Board of the Town of Clifton Park. That sketch may be changed, altered or amended by approval of the Planning Board.
B. 
The Clifton Park-Halfmoon Public Library Planned Unit Development District will consist of two separate lots with a two-story, fifty-five-thousand-square-foot new library building, with a single access drive off of Moe Road, parking for approximately 223 cars, a multi-use path and stormwater management on Lot No. 1 and a preexisting single-family residential home with a private driveway and attached garage on Lot No. 2.
C. 
Parking setback and building setbacks will be as displayed on Exhibit B.
D. 
Green space on Lot No. 1 will be approximately 5.8 acres, or 55%, including the planned multi-use path and undeveloped wetlands. Green space on Lot No.2 will be approximately 85%.
E. 
Parking areas shall be provided at all times and shall be not less than 223 spaces for Lot No. 1, and 2 spaces for Lot No. 2.
F. 
On-site directional signs shall identify the library to be built on Lot No. 1 as required. The size, height, lettering, style, illumination and placement of all signs on Lot No. 1 shall be in accordance the Town's signage and Zoning Code regulations.
G. 
A right-of-way shall be reserved on the western portion of both Lot No. 1 and Lot No. 2 for the widening of Moe Road and the creation of a lefthand turn lane in accordance with the recommendations contained in the final traffic impact study performed by Creighton Manning Engineers LLP.
Water shall be provided by the Clifton Park Water Authority. The sewer system is to be serviced through the Saratoga County Sewer District No. 1.
All improvements shall be designed and constructed pursuant to plans and specifications approved by a duly licensed architect and/or engineer and in full compliance with the New York State Uniform Fire Prevention and Building Code. When completed, these improvements shall be certified as having been constructed in full compliance with the New York State Uniform Fire Prevention and Building Code. The engineer and/or architect performing the work herein described shall be employed at the sole expense of the owner and/or developer. All construction shall be subject to inspection and approval by the appropriate officials of the Town of Clifton Park.
Prior to the commencement of any phase of construction within the planned unit development district, or prior to the issuance of any building permit, final site plans and specifications shall be submitted to the Planning Board for its review and approval in accordance with the Town Code of the Town of Clifton Park.
Local Law No. 10 of 1996, entitled "Zoning Code of the Town of Clifton Park," is hereby amended by providing that the Clifton Park-Halfmoon Public Library Planned Unit Development District be set forth on the Town Zoning Map.
