Chapter 118 Historic Places, Preservation of

§ 118-1 Acquisition procedure.

It is hereby determined that the Town Board may acquire places determined to be of an historical nature, including buildings and sites and memorabilia. Such acquisition shall be performed in the following manner:

The Town Board shall notify the property owner or owners that it desires to protect, enhance and perpetuate such site or property as an historical site or building.

Thereupon the Town Board and the property owner may meet and determine whether an adequate compensation for such property can be agreed upon.

In the event that the parties can not agree, each may be entitled to the appointment of one appraiser, together with one appraiser who shall be appointed by mutual consent. The figure arrived at by these appraisers shall be binding on both parties.

§ 118-2 Responsibility subsequent to acquisition.

Thereafter and upon the acquisition of the property by agreement, arbitration or condemnation, the Town Board may enter upon and be responsible for the further protection and enhancement of the property.

§ 118-3 Retention of residency.

The Town Board may, if it so desires, permit the resident of any building or structure to remain during his or her lifetime or may make such other agreement as shall be in the public interest.

§ 118-4 Imposition of special restrictions.

The Town Board is hereby empowered to impose any special restrictions or zoning regulations which it deems necessary for the protection of the property or enhancement of the building or site, which said power shall be exercised pursuant to the provisions of existing statutes, including § 261 of the Town Law and § 96-a of the General Municipal Law.
