The following rules and regulations restricting
private employment of employees of the Fire Department are adopted
as follows:
A.
No employee of the Fire Department shall solicit,
accept or otherwise engage in, directly or indirectly, any private
business interest while on duty.
B.
No employee of the Fire Department shall solicit,
accept or otherwise engage in any private business interest on behalf
of themselves, another employee or any other person while conducting
building inspections in his/her capacity as an employee of the Department.
C.
No employee shall solicit, accept or engage in or
on behalf of themselves or others any off-duty work on any real property
in the City of Kingston which is then under citation by the Building
Department for Uniform Code violations.

D.
No employee of the Fire Department shall perform inspections
for compliance with the Uniform Code on property if an employee of
the Department or a person with whom the employee has a private business
relationship has an ownership or a leasehold interest in said property
or has previously performed any off-duty work on said property. In
the event that the employee with such an ownership interest or previous
off-duty work experience learns his or her company has been assigned
to inspect said property, the employee shall disclose his or her interest
to their immediate supervisor, in writing. This prohibition shall
not prevent an employee from performing corrective work on real property
then under Building Department citation if the employee owns the real
property and is otherwise legally able to engage in this type of work.

E.
Any employee of the Fire Department who shall engage
in off-duty employment within the City of Kingston in the nature of
real property construction, renovation, plumbing, electrical or any
other work of the type subject to Building Department building inspections
shall disclose said employment, in writing, to the Chief of the Fire
Department.

A.
Violations of this article will subject the employee
to disciplinary charges pursuant to Article 18 of the Collective Bargaining
Agreement between the city and the Kingston Professional Firefighters
Association and possible termination.
B.
Violations of this article will subject any employee
who is a member of the Civil Service Employees Association to disciplinary
charges pursuant to § 75 of the New York State Civil Service
Law and possible termination.
