As used in this chapter, the following terms shall have the meanings indicated:
DOMICILIARY
In the context of what follows, a person having a permanent residence within the County of Ulster, New York, and its geographic borders and who has the intention that same be his or her permanent domicile.
EMPLOYMENT
Deemed to embrace all forms of employment, including, but not limited to, civil service exempt, competitive and noncompetitive civil service, and provisional employment, where the compensation for such employment is provided for out of general revenues of the City of Kingston, or out of revenues of any agency thereof where the budgets involved are subject to approval of the Common Council or Mayor.
GEOGRAPHIC LIMITS
The boundary lines of the City of Kingston, New York, as set forth on the Official Map of the City of Kingston, New York, controlled by the Office of the City Engineer.
Except as otherwise provided in laws, statutes, rules and regulations which are superior to and binding upon the City of Kingston, New York, and which provide that employment in certain categories shall be open to applicants from a wider geographic base, all employment by the City of Kingston, New York, shall be restricted to domiciliaries of the County of Ulster, New York, who are domiciled within not to exceed a ten-mile radius externally from the geographical limits of the City of Kingston.
All persons originally employed on the basis of their domicile within such geographic limits who shall, during the term of such employment, remove therefrom and establish domiciliaries elsewhere, shall thereupon forfeit their right of continued employment forthwith, and the position so occupied by such persons shall thereupon be deemed vacated.
Nothing herein contained shall require the City of Kingston, New York, or any of its departments to limit employment as hereinabove provided with respect to any position of employment for which, by reason of special skills, aptitudes and expertise, an appropriate appointment cannot be made to fill such position with a domiciliary, but before any such exceptions shall become effective, it shall be necessary for the Common Council of the City of Kingston, New York, or if the position to be filled in the City of Kingston Laboratory, the Board of Managers of said laboratory, upon certification of the necessary facts and by appropriate resolution, to exempt such position or positions from the restrictions herein contained, including the restriction on continued domicile, and the Common Council, or the Board of Managers of the City of Kingston Laboratory, should the positions to be filled exist in said laboratory, may thereupon relax such restriction by appropriate resolution, either eliminating geographic limitations or extending the same.
Nothing herein contained shall affect the continued employment of persons now employed by any department or agency of the City of Kingston, New York, where such employment and the right of employee has become vested in a person or persons who would otherwise be disqualified from serving as such employee by reason hereof.
