The discharge of scavenger wastes into the City of Kingston POTW shall be permitted only with the written approval (permit) of the City Engineer. Applicants for such permit shall apply on a form provided by the City Engineer. These forms may require information such as vehicle specifications, vehicle license number, vehicle color, NYSDEC permits issued under 6 NYCRR Part 364, approximate annual septage volume expected, service areas and any other information which the City Engineer may require to determine whether the scavenger wastes could adversely impact the POTW. The application shall be accompanied by a nonrefundable fee as set forth in the fee schedule to be established by resolution of the Common Council of this City[1] made payable to: the Comptroller, City of Kingston. The scavenger permittee will also be charged a fee for each dumping in accordance with the schedule of charges as set forth elsewhere in this chapter. The dumping fee shall be paid prior to dumping.

The applicant for a permit shall be the owner of the vehicle or vehicles to be used for such discharge. Any false or misleading statement in any permit application shall be grounds for invalidating the permit. All permits issued by the City Engineer for this purpose shall be valid for one year. The permittee shall also be duly permitted by the NYSDEC under 6 NYCRR Part 364 (364 permit). If for any reason the permittee loses his 364 permit, then the permit issued under this article shall become immediately invalid. All acts performed in conjunction with the permit shall be subject to the inspection and regulations established by the City Engineer, the terms and conditions of the permit and all local and general laws, ordinances and regulations which are now or may come into effect, and any permit may be revoked at any time by the City Engineer for willful, continued or persistent violation thereof.
The charge for dumping septage into the POTW shall be calculated and set by the City Engineer. The manner of determining the volume shall be at the discretion of the City Engineer.
A. 
The City Engineer may require discharging at certain specified locations, seasons of the year, days of the week and times of the day, as shall be stated on said permit or revised by the City Engineer.
B. 
Each discharge of scavenger wastes shall be made only with the approval of the City Engineer. The City Engineer may require inspection, sampling and analysis of each load prior to its discharge into the POTW. Any extra costs associated with such inspection, sampling and/or analysis shall be paid by the permittee.
