Enactment and enforcement of this chapter and the Industrial Pretreatment Program requires stringent methodology for information gathering, recordkeeping and updating of files and the issuance of wastewater discharge permits pertinent to industrial users.
A. 
It shall be the duty of the City Engineer's Office to organize, coordinate and maintain communications with and between all industries and agencies relevant to compliance with these regulations.
B. 
Files shall be kept by the City Engineer's office on all industries discharging into the POTW. Said files shall include:
(1) 
Name, address and property description of the industry.
(2) 
Name and phone number of contact person(s).
(3) 
Fast report on significant industries (SIU's only).
(4) 
Industrial waste survey.
C. 
Said files shall be reviewed and upgraded no less than every three calendar years.
D. 
In order to assure that files are kept timely and complete, communication shall be maintained and the names and addresses of new commercial/industrial applicants/accounts shall be received from the Water Department, Building Department and Planning Department. Periodic review of alternate source material such as telephone and city directories shall also be utilized in maintaining accurate and current files.

E. 
Users identified as SIU's shall be required to submit self-monitoring reports on a schedule to be determined by the City Engineer on a case by case basis. Violations shall be identified and noted even if no action is to be taken. If reports indicate that enforcement action is needed, such action shall be carried out by the City Engineer's office in strict compliance with established procedures and this chapter.
F. 
Responses to violations shall take into consideration the following:
(1) 
Magnitude of the violation.
(2) 
Duration of the violation.
(3) 
Effect of the violation on receiving waters.
(4) 
Effect of the violation on the POTW.
(5) 
Compliance history of the user.
(6) 
Good faith of the user.
G. 
Enforcement responses shall be in accordance with guidelines set forth in the EPA publication Guidance for Developing Control Authority Response Plans and the City of Kingston's enforcement response plan.
H. 
In coordination with the personnel of the Kingston wastewater treatment plant, the City Engineer's Office shall investigate all instances of noncompliance.
I. 
Industrial user facility site inspections shall take place once a year, and sampling at each discharge site shall take place at least twice a year. Such sampling may be escalated at the discretion of the City Engineer, as deemed necessary.
A. 
The City of Kingston will provide adequate staffing in order to comply with all requisites of CFR Part 403 and all phases of the Industrial Pretreatment Program, as set forth in this chapter.
B. 
The City of Kingston shall provide adequate funding for the procurement of outside consulting services to assist in those tasks requiring specialized expertise beyond the scope of city personnel, as determined to be necessary by the City Engineer.
C. 
Additional staffing shall be provided as required to promote the safe and efficient operation and maintenance of the POTW and to meet EPA standards in the promulgation of the SPDES permit requirements and all other permits and orders issued thereunder.
D. 
The City of Kingston shall make provision for a Corporation Counsel to provide legal assistance in the promulgation of this chapter and the enforcement response plan.
E. 
The City of Kingston shall provide whatever equipment is necessary in order to comply with all requisites of CFR Part 403 and all phases of the Industrial Pretreatment Program as set forth in this chapter, as well as to ensure staff health and safety.
The City of Kingston shall provide whatever level of funding is necessary as determined and recommended by the City Engineer to fully and effectively implement a comprehensive Industrial Pretreatment Program, as set forth in this chapter and fully comply with all requisites of CFR Part 403.
