This article shall be known and may be called "Prohibiting the Depositing of Snow and Ice on the City Streets" of the City of Kingston, New York.
The following definitions shall apply in the interpretation and enforcement of this article. As used in this article, the following terms shall have the meanings indicated:
ROADWAY
That portion of a street or highway improved, designed or ordinarily used for vehicular traffic, exclusive of the berm or shoulder.
SIDEWALK
That portion of a street between the curblines or the lateral lines of a roadway and the adjacent property lines intended for use of pedestrians.
STREET or HIGHWAY
The entire width between the boundary lines of every publicly maintained thoroughfare when any part thereof is open to the use of the public for the purposes of vehicular travel.
A. 
No person, no firm or corporation shall deposit or cause to be deposited any snow or ice on or against a fire hydrant or on any street, highway or roadway which has been cleared or plowed of snow and ice and, being expressly provided that until such snow clearance of the state highway or roadway, property owners may deposit accumulated snow and ice from their properties at the curbline incident to the clearance of sidewalks.
B. 
Nothing herein contained shall permit any commercial establishment or person or persons to gather accumulated snow from parking grounds or parking areas owned by them or in their control and to deposit the same in the public street at any time.

Any person, firm or corporation who violates any provision of this article shall be deemed guilty of an infraction thereof and shall be subject to a fine, upon conviction, in an amount not to exceed $50 for the first offense, $100 for the second offense and $200 for the third and any subsequent offenses in any one winter season between November 15 and April 15.
