This chapter shall be known as the "New Rochelle
Building Code." It shall incorporate the standards found in the Building
Code of New York State, Residential Code of New York State, and Energy
Conservation Construction Code of New York State, which shall be referred
to in this chapter as the "State Code."
This chapter controls all matters concerning
the construction, alteration, addition, repair, removal, demolition,
use, location, occupancy and maintenance of all existing and proposed
buildings and structures and their appurtenant constructions, including
retaining walls, vaults, area and street projections and additions,
in the City of New Rochelle, except as such matters are otherwise
provided for or exempted in other ordinances or statutes of the City
of New Rochelle and/or the State of New York.
The legal use and occupancy of any structure,
building permits, certificates of occupancy, permits and violations
existing at the time of adoption of this code shall continue without
change except as may be specifically covered in this code or as may
be deemed necessary by the Building Official for the general safety
and welfare of the occupants and the public.
