The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

A.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XII (§ 312-83), attached to and made a part of this chapter.
B.
No person shall park a vehicle at any time upon any off-street property owned or controlled by the City of New Rochelle except where such parking is specifically permitted in public parking lots and garages pursuant to Article VII hereof.

C.
No person shall park a vehicle at any time upon any public street, public parking lot, or public garage that is not properly registered as defined in § 401 of the New York State Vehicle and Traffic Law, or in accordance with the applicable vehicle and traffic laws of the state in which the vehicle was properly registered.

D.
At the discretion of the Commissioner of Public Works and when an accident study indicates it is warranted, no person shall park a vehicle at any time upon any parts of public streets within marked lines forming a rectangle with curb described in § 312-100, Schedule XXIX, attached to and made part of this chapter.

No person shall park a vehicle on any streets or parts of streets thereof described in Schedule XXVIII (§ 312-99), following a snow event of two inches or more, unless and until the sooner of:

No person shall park a vehicle between the hours specified in Schedule XIII (§ 312-84) of any day, unless otherwise indicated, holidays excepted, upon any of the streets or parts of streets described in said Schedule XIII, attached to and made a part of this chapter.

Notwithstanding the provisions of § 312-40, alternate side of the street parking restrictions, as indicated in Schedule XIII (§ 312-84), shall be suspended for the period January 1 through March 31 on those streets and portions of streets indicated as being subject to winter suspension of alternate side of street sweeping parking regulations in Schedule XIII, attached to and made a part of this chapter.

Except as provided in Article V, no person shall park a vehicle for longer than the time limit shown in Schedule XIV (§ 312-85) at any time between the hours listed in said Schedule XIV of any day, unless otherwise indicated, holidays excepted, upon any streets or parts of streets described in said Schedule XIV, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XV (§ 312-86) except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.

A.
It shall be unlawful to park a commercially licensed vehicle or a noncommercial trailer or tractor-trailer/semitrailer in a street or public property in excess of three hours between the hours of 6:00 p.m. and 8:00 a.m. Monday through Saturday or any time on Sunday, unless said vehicle is engaged in the process of delivery to a premises. Notwithstanding the foregoing, commercially licensed vehicles may be parked between the hours of 6:00 p.m. and 8:00 a.m. Monday through Saturday and all day Sunday in those City parking lots designated in Schedule XXVII herein, on the following terms and conditions:
(1)
A valid City-issued parking permit shall be purchased and displayed for the particular vehicle in the particular lot.
(3)
Only those vehicles which can fit into a parking space, as lined for passenger vehicles, shall be entitled to this permit.
(4)
All vehicles must be closed vehicles such as vans or capped pickup trucks.
(5)
Issuance of this parking permit shall be conditioned on completing and submitting to the City a general release which covers both the vehicle and its contents.
B.
A residential area includes any district designated by the Zoning Ordinance of the City of New Rochelle as R-1AA, R-1A, R-1B, R-2, R-3A, R-3B, R-4 or R-5, or any other district which may be designated as a residence district. For the purpose of this section, any district designated by the Zoning Ordinance shall be deemed to extend to the center of the street abutting.
C.
It shall be unlawful to park a bus having a capacity of more than eight passengers in residential areas of the City for a period of more than one hour.
D.
It shall be unlawful to park a commercially licensed vehicle in a street located in a residential area in excess of one hour unless said vehicle is engaged in the process of delivery or the rendition of a service to a premises in said residential area.
E.
This § 312-43 shall not apply to motor vehicles defined as "livery vehicles" exceeding 220 inches in length or "taxicabs" by the New York State Vehicle and Traffic Law.

Pursuant to the authority set forth in § 181 of the General Municipal Law, motor vehicles defined as "taxicabs" or "livery vehicles" by the New York State Vehicle and Traffic Law shall be subject to the following additional restrictions:
A.
Livery vehicles exceeding 220 inches in length and taxicabs shall not be parked on public streets in excess of the shorter of: the time-limits, if any, for the applicable street and two hours.
B.
Livery vehicles exceeding 220 inches in length and taxicabs may park in municipal parking lots and garages under the same restrictions and parking rates as set forth for passenger vehicles in this chapter.
C.
Livery vehicles exceeding 220 inches in length and taxicabs shall not stand on any public street or in any municipal parking lot and garage, except in designated taxi stands.

No motor vehicle or trailer, as they are defined in the Vehicle and Traffic Law of the State of New York, shall be parked on any street or public place for more than 48 continuous hours.
No person shall stop or stand a vehicle upon any of the streets or parts of streets described in Schedule XVI (§ 312-87), attached to and made a part of this chapter.
The locations described in Schedule XVII (§ 312-88), attached to and made a part of this chapter, are hereby designated as loading zones.
A.
The locations described in Schedule XVIII (§ 312-89), attached to and made a part of this chapter, are hereby designated as taxi stands.
B.
Livery vehicles exceeding 220 inches in length and taxicabs parked in designated taxi stands shall be operator-attended at all times.

C.
No person other than a New Rochelle licensed taxicab operator operating a licensed New Rochelle taxicab, as licensed under Chapter 290 of the New Rochelle City Code, shall stand in the locations described in § 312-89, Schedule XVIII: Taxi Stands, attached to and made a part of this chapter, hereby designated as taxi stands.

A.
The locations described in Schedule XIX (§ 312-90), attached to and made a part of this chapter, are hereby designated as bus stops.
B.
No person shall park or stand any vehicle, except as otherwise allowed by this section, at a designated bus stop.

Notwithstanding any other penalty provision of this chapter, a violation of this section shall be punishable by a fine of not more than $50.

A.
No person shall park or stand any vehicle in any part of a roadway designated by official signs as "handicapped parking," except a vehicle displaying a valid handicapped identification or insignia or in an emergency or at the direction of a police officer. Handicapped parking spaces are as designated in Schedule XX (§ 312-91), attached to and made a part of this chapter.
B.
Any person who parks in a space marked for use by the handicapped in an off-street shopping center facility wherein such space is provided in accordance with § 1203-c of the Vehicle and Traffic Law of the State of New York, without a special parking permit therefor, or whose motor vehicle is not registered in accordance with the provisions of § 404-a of the Vehicle and Traffic Law of the State of New York and being used for the transportation of a handicapped person, shall be subject to a fine of $100. Such fine shall be mandatory.

No person shall, at any time, park, stop or stand a vehicle in any fire lane designated as such in Schedule XXI (§ 312-92), attached to and made a part of this chapter.

The locations described in Schedule XXV (§ 312-96) attached to and made a part of this chapter, are hereby designated as parking permit zones for public business at or adjacent to government facilities.

A.
Purpose, intent and findings. The City Council has found and determined that residents living in the Sutton Manor neighborhood are suffering interference to the tranquility and quiet enjoyment of their neighborhood by reason of visitors and users of the nearby New Rochelle Station, by shoppers, diners and users of New Rochelle's downtown area, and by owners of commercial vehicles from the villages, towns, boroughs and cities neighboring Sutton Manor. Each of the foregoing individuals park in the Sutton Manor as a free and convenient alternative to paid, permit parking in and around New Rochelle and its surrounds. This use has caused significant safety issues, refuse and sanitation problems, traffic hazards, congestion, air and noise pollution and other disturbances which cumulatively have severely deteriorated the peace, tranquility and quality of life of the residents of this neighborhood. For the foregoing reasons, the City Council has decided to enact the residential parking permit system set forth herein.
B. DEPARTMENT OF DEVELOPMENT GUEST PASS RESIDENT RESIDENTIAL PARKING PERMIT RESIDENTIAL PARKING PERMIT AREA
Definitions. As used in this section, the following terms shall have the meanings indicated, unless the context clearly requires otherwise:
The City of New Rochelle Department of Development.
A decal or hangtag issued by the Department of Development to a resident to be displayed by a resident guest in accordance with this section.
An individual currently residing within the residential parking permit area based on the submission of adequate documentation in accordance with the provisions of this section.
A permit issued by the City of New Rochelle to a resident meeting all permit requirements in accordance with this section. All applications for residential parking permits shall be submitted through the New Rochelle online permit system.

C.
Designation of residential parking permit area; permit required; hours.
(1)
A residential parking permit system is hereby established within the residential parking permit area, as defined herein.
(2)
Except as otherwise provided herein, no person shall park a vehicle, nor allow a vehicle to be parked at any time, excluding holidays, along any street that has been designated a residential parking permit area pursuant to this section, unless the vehicle has a residential parking permit or guest pass in accordance with this section.
(3)
A permitted vehicle shall have a valid residential parking permit or guest pass. A guest pass must be displayed either on the vehicle's rear windshield or rear-view mirror, or such other location on the vehicle as the Department of Development may determine.
D.
Issuance of residential parking permits.
(1)
Upon application and payment of the applicable fee on the City's online permit system, any person who is a resident and who meets the applicable requirements of this section shall be issued one valid residential parking permit for each vehicle registered in the applicant's name and up to two guest passes per household within the residential parking permit area. The Department of Development shall establish guidelines to issue residential parking permits and guest passes, including proof of residency. Residential parking permits and guest passes shall be valid for one calendar year and must be renewed annually before the permit and guest pass expire.
(2)
Permits issued under this section shall be specific for a single vehicle and shall not be transferred. Guest passes issued under this section shall be specific to a single household, shall not be transferred among households and shall be displayed only as the Department of Development prescribes. The permittee shall immediately notify the Department of Development of any change or amendment from the information contained in the original application.
(3)
In the event of the loss or destruction of any parking permit, the Department of Development shall issue a new one upon signing of an affidavit by the permittee as to the loss or destruction of the original parking permit for a fee as set forth in Chapter 133, Fees. In the event the permit was stolen, the fee will be waived upon the furnishing of a copy of a Police Incident Report.
(4)
In the event the annual permit/guest pass fee is not paid in full within five business days of the commencement of the period for which the permit has been applied for, a late payment charge equal to 5% of the annual fee will be imposed.
(5)
Changing a permit because of a new vehicle, new license plate, or for adding a vehicle is free if completed online. If changes are made in person, there is a $20 administrative fee. Administrative Fee waivers are available to permit holders who have demonstrated a hardship.
(6)
If payment is made by check, and it is returned for any reason, applicant must pay the returned check fee of $20.
(7)
Permittees will not be notified as to the expiration of each term and shall be required to forward to the Department of Development the renewal a minimum of two weeks before the date of expiration. Permittees shall be required to file a new application upon changing the vehicle, any other change required in the application form and upon renewal. Renewal payment, if made by mail, is to be by check or money order.
(8)
A parking permit issued under this Chapter shall be displayed by either hanging from the rear-view mirror in the City-issued hangtag or on the dashboard near the vehicle registration at all times when parked in an authorized space, and in such a manner that the entire face of the parking permit is visible from the outside of the vehicle.
(9)
Parking without displaying the permit is subject to a summons.
(10)
The permit shall not be altered or duplicated. Display of an altered or duplicated permit is subject to summons.
(11)
The permittee shall be required to obey all other rules and regulations of the City of New Rochelle.
F.
Nonresident parking exception. Notwithstanding anything to the contrary herein, vehicles without a residential parking permit or guest pass issued pursuant to this section may be parked within the residential parking permit area for a period not in excess of 90 minutes except holidays.
G.
Exemptions.
(1)
Motor vehicles registered pursuant to § 404-a of the New York State Vehicle and Traffic Law shall be exempt from any permit requirement established pursuant to this chapter.
(2)
Vehicles owned and operated by utility companies, the United States of America, New York State, Westchester County, New Rochelle, New Rochelle School District or contractors while engaged in their trade shall be exempt from any permit requirement established pursuant to this chapter.
(3)
No residential parking permit or guest pass shall be required on those portions of streets within the residential parking permit area where the adjacent properties are zoned for commercial or retail use.
(4)
No less than 20% of all parking spaces within the residential parking permit area shall be available to nonresidents.
H.
Conflicts. To the extent that the provisions in this section conflict with any other provisions in Chapter 312, the provisions herein control.
I.
Penalties for offenses. Any person violating any provisions of this section of this chapter may, upon conviction, be punished by a fine not exceeding $100.
J.
Revocation.
(1)
The Department of Development may revoke a resident parking permit or guest pass when it is found that a false or fraudulent application has been filed or it is found that the resident parking permit or guest pass was improperly or wrongfully issued.
(2)
The Department of Development may deny an application or revoke a resident parking permit or guest pass if the resident has three or more outstanding and unpaid parking violations issued by the City of New Rochelle against the resident or any vehicle registered in the resident's name.
(3)
The Department of Development shall provide notice of such revocation, and the effective date of such revocation shall be the date of such notice. Such notice shall provide that any guest pass shall be returned to the Department of Development.
(4)
Residents who had had their residential parking permit or guest pass revoked may apply for and be issued a new residential parking permit or guest pass if they provide evidence sufficient to the Department of Development that all outstanding parking tickets issued in the resident's name or in the name of the owner of the vehicle have been paid in full.

A. ACTIVE DUTY ARMED FORCES DEVELOPMENT COMMISSIONER PARKS COMMISSIONER RESERVE RESERVE COMPONENT VETERAN
Definitions. As used in this section, the following terms shall have the meanings indicated:
Full-time duty in the United States Armed Forces, other than active-duty training.
United States Army, Navy, Marine Corps, Air Force, Space Force, and Coast Guard, including the reserve components thereof.
The Commissioner of the City of New Rochelle Department of Development.
The Commissioner of the City of New Rochelle's Parks and Recreation Department.
A member of a reserve component of one of the Armed Forces.
The term "reserve component" means, with respect to the Armed Forces, the Army Reserve, the Navy Reserve, the Marine Corps Reserve, the Air Force Reserve, the Coast Guard Reserve, the Army National Guard of the United States, and the Air National Guard of the United States.
A person who served in the active military, naval, air, or space service, and who was discharged or released therefrom.
B.
Designation of spaces. Notwithstanding any provision of law to the contrary, the Development Commissioner and the Parks Commissioner are hereby authorized, empowered, and directed to designate a minimum of one parking space at each of the facilities identified below for the exclusive use of parking by current New Rochelle residents who are:

(2)
To the extent practicable, spaces designated for parking by Active-Duty Members, Reserve Members, and Veterans of the United States Armed Forces shall be located in the immediate vicinity of those spaces designated for use by the handicapped. In no event, however, shall designated parking spaces be located closer to a facility entrance than those spaces designated for use by the handicapped.
(3)
The Development Commissioner and Parks Commissioner shall post appropriate signage and markings to allow for the enforcement of this article.
D.
Display of credentials. Eligibility for use of the designated space must be demonstrated by appropriate identification issued by the United States Department of Defense, the United States Department of Veterans Affairs, or other documentation approved by the City Clerk, and a hanging tag or sticker issued by the City of New Rochelle.
E.
Payment requirements. Use of designated spaces shall remain subject to all applicable parking fees, meters, and regulations in effect at the facility.
F.
Prohibited parking. Any person who parks a vehicle in a parking space reserved for Active-Duty Members, Reserve Members, and Veterans of the United States Armed Forces without the proper credentials established in § 312-50.3D shall be deemed to be in violation of this article. The owner of such vehicle shall be responsible for the penalty imposed hereunder.
G.
Penalty for offenses. Any person violating the provisions of this article shall be subject to a fine not to exceed $100.
H.
Enforcement. Provisions of this article shall be enforced by the City of New Rochelle Police Department.
I.
Severability. If any clause, sentence, paragraph, subdivision, or part of this section shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof.
J.
When effective. This article shall take effect 90 days after filing with the Secretary of State of the State of New York.
