It shall be unlawful for any person, except in defense of person or property, to hunt, trap, chase, shoot at, take kill or pursue with intent to take, kill or wound any wild bird or animal by any method, or with any weapon, including the use of dogs, on land within the Township of East Whiteland, Chester County, Commonwealth of Pennsylvania, without first having obtained the written permission of the owner, lessee or custodian of such land.
For purposes of this chapter, the following definitions shall apply:
HUNT
The traversing of a tract or parcel of land in pursuit of game for food or sport.
WEAPON
Any shotgun, rifle, air rifle, pistol, revolver, pellet gun, or instrument of similar type, and any bow used to propel an arrow.
Any person who shall have received the written permission of the owner, lessee or custodian of land within East Whiteland Township, to hunt thereon, shall carry upon his person a written authorization signed by the owner, lessee or custodian of the land specifically designating the holder of the authorization, whose name and address shall be clearly shown thereon, as a person having permission to hunt upon the land. Such authorization shall be dated and shall be valid only for that period as appears on the face of the permittee's then-current state hunting license.
Any person who violates or permits the violation of any provision of this chapter shall, upon conviction thereof in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense, and shall be subject to the payment of a fine of not less than $100 and not more than $1,000, plus the costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a term of not more than 30 days. Each provision of this chapter that is violated shall constitute a separate offense, each of which violations shall be punishable by a separate fine imposed by the District Justice of not less than $100 and not more than $1,000, plus the costs of prosecution, or upon default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a term of not more than 30 days. All fines and penalties collected for the violation of this chapter shall be paid to the Township Treasurer.
