PEDDLER
PEDDLING
PERSON
As used in this chapter, the following terms shall
have the meanings indicated:
Any person who shall engage in peddling, as herein defined.
Engaging in peddling, canvassing, soliciting or taking of
orders, either by sample or otherwise, for any goods, wares, services
or merchandise upon any of the streets or sidewalks or from house
to house within Lower Saucon Township, provided that the word peddling
shall not apply to farmers selling their own produce; to the sale
of goods, wares, services and merchandise, the proceeds whereof are
to be applied to any charitable or philanthropic purpose; or to any
manufacturer or producer in the sale of bread and bakery products,
meat and meat products or milk and milk products.
Any natural person, association, partnership, firm or corporation.
B.
In this chapter, the singular shall include the plural
and the masculine shall include the feminine and the neuter.

No persons shall engage in peddling in Lower
Saucon Township without first obtaining a permit for such activities
from the Lower Saucon Township Police Department, as hereinafter provided.
Once a permit has been obtained, no persons shall engage in peddling
in Lower Saucon Township unless they have notified the Police Department,
at least 24 hours in advance, of the dates they intend to conduct
such peddling activities in the Township.

A.
Every person desiring to engage in peddling in Lower
Saucon Township shall first submit an application for a permit, along
with the required permit fee, to the Lower Saucon Township Police
Department. If such person shall also be required to obtain a permit
from Northampton County to engage in such activities, then he or she
shall submit the county permit at the time of the application to the
Township. The application shall require the disclosure of the person's
name and address, his or her previous criminal record (along with
a copy of a criminal history report obtained from the Pennsylvania
State Police, at the applicant's expense), the type of goods, wares
and merchandise he or she wishes to peddle, the length of time for
which he or she wishes to be permitted, the type and make of vehicle
he or she uses, if applicable, and the number of persons assisting
the applicant in the peddling activities. All information required
to be submitted for the applicant shall also be submitted for each
person assisting the applicant. No permit shall be issued to any person
who has, within the last 10 years from the date of the application,
been convicted, or served a sentence or period of criminal probation,
for any felony or misdemeanor involving moral turpitude (as that term
is defined in Section 237.9 of the Pennsylvania Code, as may be amended
from time to time). Only one permit per organization shall be required.
All permits shall be valid for a maximum period of six months.
B.
No permit issued under this chapter shall be transferable
from one person to another.

No permit shall be issued under this chapter
until the proper fee shall be paid to the Police Department, which
shall be for the use of the Township. Said fees shall be set from
time to time by resolution of the Council.[1]

Upon making application thereof and paying the
proper fee, as herein specified, a permit shall be issued to every
peddler. Such permit shall contain the information required to be
given upon the application therefor. Every peddler shall, at all times
when engaged in peddling in the Township, carry such permit upon his
or her person and shall exhibit such permit, upon request, to all
police officers, Township officials and citizens. No peddler shall
engage in selling any product not mentioned upon such permit, nor
shall any person having a foot-peddler's permit operate from or with
any motor vehicle.

A.
No person
obtaining a permit under the provisions of this chapter shall engage
in peddling before 9:00 a.m. or after 6:00 p.m. In addition, no peddling
is permitted on Sundays.
B.
The Lower
Saucon Township Police Department shall maintain a registry of individual
property owners who have registered their property with the Department
as a "no peddling" property. The Department shall provide all persons
issued a permit with a copy of this registry. Any contact with a property
owner listed on the registry shall constitute a violation of this
chapter and shall be grounds for revocation of a permit.

No person permitted as a peddler under this
chapter shall hawk or cry his or her wares upon any of the streets
or sidewalks of the Township, nor shall he or she use any loudspeaker
or horn or any other device for announcing his or her presence by
which the public is annoyed.

No person permitted as a peddler under this
chapter shall park any vehicle upon any of the streets or alleys of
the Township in order to sort, rearrange or clean any of his or her
goods, wares or merchandise; nor may any such person place or deposit
any refuse upon any of such streets or alleys; nor may any such person
maintain or keep a street or curbstone market by parking any vehicle
upon any street or alley in the Township for longer than necessary
in order to sell therefrom to persons residing in the immediate vicinity.

No person permitd as a peddler under this chapter
shall occupy any fixed location upon any of the streets, alleys or
sidewalks of the Township for the purpose of peddling, with or without
any stand or counter.

The Police Department shall keep a record of
all permits issued under this chapter. The Police Department shall
supervise the activities of all holders of such permits.

The Police Chief of Lower Saucon Township is
hereby authorized to revoke any permit issued under this chapter or
for giving false information upon any application for a permit hereunder.

This chapter shall be enforced by action brought
before a Magisterial District Judge in the same manner provided for
the enforcement of summary offenses under the Pennsylvania Rules of
Criminal Procedure. Any person who violates or permits the violation
of this chapter shall, upon conviction in a summary proceeding, be
punishable by a fine of not more than $1,000 or by imprisonment for
a term not exceeding 90 days. Each day or portion thereof that such
violation continues, or is permitted to continue, shall constitute
a separate offense. Each section of this chapter that is violated
shall also constitute a separate offense.
