The purpose of this article is to regulate drainage
upon Township roads and to prevent obstruction of or interference
with drainage upon Township roads.
Unless otherwise expressly stated, the following
terms shall have the meanings herein indicated:
PERSON
An individual, a partnership or a corporation.
PRIVATE WAY
A driveway, road, lane or alley other than a Township road.
TOWNSHIP ROAD
A road which is part of the Township's road system or is
dedicated to public use, but shall not include a road which is part
of the state highway system.
No person shall construct or open the intersection
of a Township road by a private way until a permit therefor shall
have been issued by the Township Manager or his designee.
Application shall be made upon a form prescribed
by the Township Manager and shall include specifications for the construction
or opening of the intersection. Approval of such application and the
specifications contained therein by the Manager or his designee shall
be required before a permit shall be issued.
No person shall construct or open the intersection
of a Township road by a private way except in accordance with specifications
approved as provided hereinbefore.
A fee as set from time to time by resolution
or ordinance, as may be required by law, shall be charged for the
issuance of a permit.

Any person who fails to voluntarily pay within
10 days to the Township the penalty imposed for violation of this
article shall be subject to a civil enforcement proceeding. Any person
who violates or permits a violation of this article, upon being found
liable therefor in a civil enforcement proceeding, shall pay a fine
of not more than $600, plus all court costs, including reasonable
attorney's fees, incurred by the Township in the enforcement of this
article. No judgment shall be imposed until the date of the determination
of the violation by the Magisterial District Judge and/or Court. If
the defendant neither pays nor timely appeals the judgment, the Township
may enforce the judgment pursuant to the applicable rules of civil
procedure. Each day a violation exists shall constitute a separate
offense. Further, the appropriate officers or agents of the Township
are hereby authorized to seek equitable relief, including injunction,
to enforce compliance herewith.
