Upon completion of all work in connection with
any length of a subdivision road within the subdivision area of an
approved plan of subdivision, the applicant may deliver to the Zoning
Enforcement Officer a written certification that all of the work in
connection with said length of road has been performed and completed
in accordance with the plan approved and these regulations. The Zoning
Enforcement Officer shall review the completed work and shall report
his findings to the Commission. Buildings upon lots or parts of the
subdivision areas served by such length of road may be occupied, and
the Building Official may issue certificates of occupancy therefor,
only if the Commission shall, by resolution, find that:
A. Completion. All work in connection with such length
of road has been performed and completed in accordance with the plan
of subdivision as approved and these regulations;
B. Connection to other roads. Such length of road directly connects with an existing public road or a completed subdivision road and, if such length is a dead-end road, a turnaround conforming to the requirements of §
480-41 of the Road Regulations has been provided;
C. Easement. Each instrument or conveyance of the subdivision
area served by such length of road contains a grant, in form and manner
satisfactory to the Commission, of a permanent and perpetual easement,
running with the land, of vehicular and pedestrian travel over such
length;
D. Provision for maintenance. Provision for maintenance of such length shall have been accomplished by one of the methods prescribed in §
485-26A; and
E. Road signage. All road signage, including stop signs,
curve signs, speed limit signs, other safety signs, and road name
signs, is in place.
Preliminary approval of a length of road hereunder shall not constitute final approval of such length as prescribed in §
485-27 nor authorize the release of any performance bond.
