Neither preliminary approval of a completed length of subdivision road under Article
VIII nor final approval thereof under §
485-27 shall constitute final approval of a completed road to be offered for acceptance by the Town pursuant to Article
V of the Road Regulations.

Whenever an applicant desires to make a change in an approved record subdivision map, he/she shall submit such map, a new record subdivision map bearing all desired changes, and a clear written statement of the changes desired and the reasons therefor. The Commission may require the applicant to file any additional items of supporting information described in §
485-12 if it considers such information reasonably necessary or appropriate to a proper disposition of the application and shall specify such items of additional information in writing sent by certified mail to the applicant within 35 days after submission of his request hereunder. The Commission shall approve, modify and approve, or disapprove any or all of such changes within 65 days after submission thereof. In deciding a request hereunder, the Commission shall consider whether or not the changes requested conform to the standards and requirements specified in Article
VII hereof.
If a court of competent jurisdiction finds any
provision of these regulations to be invalid or ineffective in whole
or in part, the effect of such decision shall be limited to the particular
provision which is expressly held to be invalid or ineffective and
all other provisions of these regulations shall continue to be separately
and fully effective.
If a court of competent jurisdiction finds the
application of any provision of these regulations to any use, land
or improvement to be invalid or ineffective in whole or in part, the
effect of such decision shall be limited to the person, property or
situation immediately involved in the controversy and the application
of any such provision to other persons, property or situations shall
not be affected.
With respect to the performance of all work
proposed or required in connection with an approved plan of subdivision
hereunder:
A. The Commission shall have and may exercise, in the administration and enforcement of these regulations, all of the authority, rights and powers of inspection, testing and enforcement prescribed in §§
480-18,
480-19 and
480-29 of the Road Regulations; and
B. The applicant and owner, or all the applicants and
owners jointly and severally hereunder, shall have and perform all
of the duties imposed by said sections of the Road Regulations upon
applicants thereunder.
For certain administrative purposes expressed
herein, the Commission hereby designates the Zoning Enforcement Officer
to act as its agent for such purposes hereunder. The Commission may,
in the administration and enforcement of these regulations, delegate,
by resolution of the Commission, such other administrative authority,
such as to inspect premises and work in progress or completed, to
order cessation of work in progress and to order correction or abatement
of conditions or work completed, as necessary or appropriate, to the
Zoning Enforcement Officer, the chief executive officer of the Town,
or to any other person designated in such resolution, including a
member of the Commission itself.
The Commission, acting under the authority of
Chapter 126 of the Connecticut General Statutes, hereby adopts and
enacts these regulations as the "Killingworth Subdivision Regulations
(Revision of 1978)." The provisions of the preceding Subdivision Regulations
(June 1976), and any amendments thereto, so far as they are the same
as in these regulations, are to be deemed continued and not as new
enactments. Any and all provisions of said prior regulations and amendments
thereto which are inconsistent with the provisions of these regulations
are hereby repealed, but this shall not affect any violation thereof
already existing or any penalty incurred, and the same may be prosecuted
or enforced as if these regulations had not been adopted.
The effective date of this revision of the Killingworth
Subdivision Regulations shall be April 3, 2001.
