GENERAL REFERENCES

As used in this article, the following terms shall have the meanings indicated:
SMOKING
A person's lighting and/or burning of a cigarette, cigar, pipe or any other smoking equipment using tobacco.
A. 
To comply with the statutes of the State of New Jersey and in keeping with the Borough's intent to provide a safe and healthful work environment, the Mayor and Council of the Borough of Alpha, County of Warren and State of New Jersey, has adopted the following smoking policy:
(1) 
Smoking is prohibited at all times in all areas within the municipal building, the police station and public works and water department facilities, including but not limited to offices, meeting rooms, corridors, garages, bathrooms, lobbies, and within, on or at all municipal pools.
(2) 
Smoking shall only be permitted either outside the municipal building, the police station and public works and water department facilities, or in Borough vehicles specifically designated as smoking vehicles.
(3) 
An employee leaving the work area to smoke outside the building may not leave his or her office unattended. Smoking shall not interfere with the employee's productivity.
B. 
This policy responds to evidence that tobacco smoke creates a danger to the health of people who are present in a smoke-filled environment and establishes the means to regulate the use of smoking materials by Borough of Alpha employees while on duty.
Every attempt will be made to obtain, to the greatest extent possible, freedom for the nonsmoker from the effects of smoking materials while preserving a reasonable degree of freedom for those who chose to smoke. Any person who violates this article shall be charged under the applicable law, including N.J.S.A. 2C:33-13, and shall appear before the Borough's Municipal Court and shall be subject to punishment upon conviction or guilty plea according to the law.
