There is hereby established in the Borough of Chatham a State Uniform Construction Code enforcing agency, consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator for the enforcement of the State Uniform Construction Code and shall be within the Borough Department of Planning and Building. All other subcode officials or other Borough employees or on-site inspection services responsible for the enforcement of the Uniform Construction Code within the Borough shall be employees of the Department of Planning and Building.
Each official position created in § 111-1 shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended (N.J.S.A. 52:27D-119 et seq.) and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217 (N.J.S.A. 52:27D-119), and N.J.A.C. 5:23 to hold each such position.
The public shall have the right to do business with the enforcing agency at one office location within the Borough except for emergencies and unforeseen or unavoidable circumstances. The Construction Official and all subcode officials shall have regular office hours, the schedule of which shall be made public and shall be posted with the Borough Clerk.

A. 
No permit as required by the Building Code shall be issued until the fee prescribed in this section shall have been paid. All applicable fees for a construction permit shall be the sum of fees listed in Subsection A(1) through (18) hereof and shall be paid before the permit is issued.
(1) 
The building subcode fee shall be:
(a) 
For all new construction: one- and two-family, $0.03 per cubic foot of building or structure volume, provided that the minimum fee shall be $150; and all others, $0.03 per cubic foot of building or structure volume, provided that the minimum fee shall be $150.
(b) 
For renovations, alterations and repairs: $20 per $1,000 of estimated cost of the work, provided that the minimum fee shall be $46.
(c) 
For additions: one- and two-family, $0.27 per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be $150; and all others, $0.20 per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be $150.
(d) 
For combinations of renovations and additions: the sum of the fees are computed separately as renovations and additions.
(e) 
For roofing and siding (one- or two-family): a flat fee of $46; commercial and all others, $17 per $1,000 of estimated cost.
(2) 
The plumbing subcode fee shall be 100% of state fees, provided that the minimum fee shall be $46.
(3) 
The electrical subcode fee shall be 100% of state fees, provided that the minimum fee shall be $46.
(4) 
The fee for plan review shall be 20% of the amount charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit.
(5) 
The fee for a permit for demolition of a building or structure shall be $50 for accessory structures, $100 for one- and two-family dwellings, and $200 for all other structures.
(6) 
The fee for a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be $20 per $1,000 of the sum of the estimated cost for moving, for new foundations and for placement in a completed condition in the new location, plus a demolition permit with a flat fee of $50.
(7) 
The fee for a permit to construct a sign shall be a flat fee of $46 per sign.
(8) 
Certificates of occupancy:
(a) 
The fee for a certificate of occupancy shall be $50 for one- and two-family residence use only.
(b) 
The fee for a certificate of occupancy shall be $100 for commercial and all uses not mentioned in Subsection A(8)(a) above.
(c) 
The fee for a certificate of continued occupancy shall be $100.
(d) 
The fee for a certificate of occupancy granted pursuant to a change of use shall be $150.
(e) 
The fee for a multiple certificate of occupancy shall be $100 for first certificate of occupancy and $50 for all others.
(9) 
The fee for a mechanical permit shall be $50.
(10) 
The fee for a variation shall be $100 each.
(11) 
The fee for a permit for installation of an elevator shall be state regulated.
(12) 
The fee for inspection of an elevator shall be state regulated.
(13) 
The fee for asbestos abatement shall be state regulated.
(14) 
The fee for lead abatement shall be state regulated.
(15) 
The fire protection subcode permit fees shall apply to fire protection and other hazardous equipment, as follows: sprinklers, standpipes, detectors (smoke and heat), pre-engineered suppression systems, gas- and oil-fired appliances not connected to the plumbing system, kitchen exhaust systems, incinerators, and crematoriums. The fire protection subcode permit fees are as follows:
(a) 
The fee for 20 or fewer heads or detectors shall be $65; for 21 to and including 100 heads or detectors, the fee shall be $120; for 101 to and including 200 heads or detectors, the fee shall be $229; for 201 to and including 400 heads or detectors, the fee shall be $594; for 401 to and including 1,000 heads or detectors, the fee shall be $822; over 1,000 heads or detectors, the fee shall be $1,050. In computing fees for heads and detectors, the number of each shall be counted separately, and two fees, one for heads and one for sprinklers, shall be charged.
(b) 
The fee for each standpipe shall be $229.
(c) 
The fee for each pre-engineered system shall be $92.
(d) 
The fee for each gas- or oil-fired appliance not connected to the plumbing system shall be $46.
(e) 
The fee for each kitchen exhaust system shall be $46.
(f) 
The fee for each incinerator shall be $400.
(g) 
The fee for each crematorium shall be $400.
(h) 
The fee for fire pump shall be $150.
(i) 
The fee for pre-action valves shall be $92.
(j) 
The fee for each smoke control system shall be $92.
(k) 
The fee for one through 12 alarm devices shall be $36; for each additional 25, the fee shall be $12 .
(16) 
The plan review and inspection fee for mechanical systems shall be 10% of the amount of the building subcode fee.
(17) 
The fee for reinstatement of a lapsed permit shall be 1/2 the fee charged originally, but not less than $25 per each subcode.
(18) 
All fees shall be rounded to the nearest dollar.
B. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Borough Council once every two years a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
C. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations established by the Commissioner of the Department of Community Affairs at N.J.A.C. 5:23, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee (subject to change) of $0.00265 per cubic foot of volume of new construction and $1.35 per $1,000 cost of renovation/alteration work. Said surcharge fee shall be remitted to the Construction Code Element, New Jersey Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30 and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal year in which the regulations first become effective, said fee shall be collected and remitted for the third and fourth quarters only.
A. 
Collection. In order to provide for the training and certification and technical support programs required by the Act (N.J.S.A. 52:27D-119 et seq.), an enforcing agency, including the Department when acting as the local agency, shall collect a surcharge fee to be based upon the volume of new construction within the Borough. Said fee shall be accounted for and forwarded to the Division of Codes and Standards in the manner herein provided.
B. 
Amount. This fee shall be in the amount of $0.00265 per cubic foot volume of new buildings and additions. Volume shall be computed in accordance with N.J.A.C. 5:23-2.28. The fee for all other construction shall be $1.35 per $1,000 of value of construction.
(1) 
No fee shall be collected for pre-engineered systems of commercial farm buildings.
(2) 
No fee shall be collected for permits to perform asbestos abatement or lead abatement.
(3) 
No fee shall be collected for permits for the construction or rehabilitation of residential units that are to be legally restricted to occupancy by households of low or moderate income, as defined in N.J.A.C. 5:43-1.5.
(4) 
No fee shall be collected for demolition of buildings or structures.
(5) 
No fee shall be collected for work consequential to a natural disaster when the local code enforcement agency is waiving its fee.
C. 
Remitting and reporting. The Borough shall remit fees to the Bureau on a quarterly basis, in conjunction with report number R-840B State Training Fee Report in accordance with N.J.A.C. 5:23-4.5 (e). Fees remitted shall be for the quarter. Checks shall be made payable to "Treasurer, State of New Jersey."
