Where the Board finds that extraordinary hardship
may result from compliance with these regulations, it may waive certain
requirements of the regulations so that substantial justice may be
done and the public interest secured, provided that such waivers will
not frustrate the spirit and purpose of the Official Map, the Zoning
Ordinance,[1] the Town Plan or these regulations.
Where the Board finds that, due to the special
circumstances of a particular plat, the provision of certain required
improvements is not required in the interest of the public health,
safety and general welfare, it may waive such requirements.
In granting waivers, the Board may impose such
conditions as will, in its judgment, secure substantially the objectives
of the standards or requirements so waived.
