Editor's Note: This local law also provided that it shall be
applicable to contracts advertised for bids on or after the effective date.
In addition, the local law provided that it shall take effect 60 days after
its enactment so that the Commissioner of Public Works may take any actions
necessary to effectuate the provisions of the local law.
The Town Board finds that apprenticeship training programs, as authorized
by New York State Labor Law § 816-b, provide opportunities for young
people to secure an education in the skilled construction trades and gain
employment which provides livable wages. The promotion of apprenticeship programs
will expand the pool of skilled workers in the Town and county and foster
the local and regional economies. By resolution, dated February 22, 2006,
the Town Board established a policy to promote apprenticeship training as
authorized by § 816-b of the New York State Labor Law so as to promote
the health, welfare and safety of the Town by improving the skills of workers
on Town construction projects.
The following terms shall have the meanings indicated:
Any Town contract to which the Town of Greenburgh shall be a signatory
where the aggregate cost of the total project is $250,000 or greater and which
involves the design, construction, reconstruction, alteration, demolition,
renovation, improvement, rehabilitation, maintenance, repair, furnishing,
finishing, equipping or otherwise providing for any building, facility or
physical structure of any kind.
An individual, sole proprietorship, partnership, joint venture, corporation
or any other form of doing business.
For any contracts for Town construction projects of $250,000 or greater,
the contractors or any subcontractors shall certify that they currently have,
and will maintain for the term of the contract and any extensions thereof,
apprenticeship agreements that have been registered with and approved by the
New York State Department of Labor appropriate for the type and scope of work
to be performed under such construction contract. In addition, they shall
certify that an appropriate number of apprentices will be utilized in performing
the contract in accordance with the Town's rules and regulations. Such
certification shall be in writing and signed by an officer of the contractor
or subcontractor.
This chapter shall not apply:
A.
To any services procured through New York State contracts
as administered by the New York State Office of General Services.
B.
Where a specific trade has not been approved as an apprenticable
trade by the New York State Department of Labor at the time of the award of
the contract.
C.
To any contracts utilizing federal, state, county or
other funding assistance to the extent that such funding precludes application
of the apprenticeship training program.
The Commissioner of Public Works is hereby authorized, empowered and
directed to promulgate such rules and regulations that are lawful, necessary
and appropriate for the implementation and enforcement of any provisions of
this chapter.
