Any merchant desiring to use sidewalk space for merchandise displays or other purposes must apply to the Village Board for a permit. Such permission may be granted to display during business hours for a space up to 36 inches from the building of such applicant, provided that a space of at least six feet from the outside of the walk is kept clear and unobstructed for the use of the public and evidence of public liability insurance if filed, upon the payment of a fee of $10 per year. The Board shall reserve the right to revoke such permits in the event of the abuse of any merchant of the permit privileges. Special permits for additional privileges may be granted by the Board of Trustees upon application duly filed with the Village Clerk.

Any person violating any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of a minimum of $25 up to the maximum penalty of $250 or by imprisonment for not more than 15 days, or both.

The requirements of this article may be waived by Village Board approval in certain instances for the betterment of the community.
