For the purposes of these regulations, certain words and terms used herein are defined as follows. (NOTE: Except where specifically defined herein, all words and terms shall carry their customary meanings.)
APPLICANT
The owner(s) of record or contract vendee who may be represented by an authority agent.
BUILDING INSPECTOR
The Building Inspector of the Town of Pound Ridge, New York, or his duly authorized representative.
BUILDING LOT
Any parcel of land not divided by roads upon which a principal residential or commercial building can be constructed in conformance with the requirements of the Zoning Ordinance.[1]
CONSERVATION SUBDIVISION
A subdivision designed in accordance with § 281 of the Town Law in which the allowable density is no greater than that which would be permitted if the property were developed as a conventional subdivision meeting all the applicable standards of the Zoning Ordinance,[2] these regulations and other applicable laws and ordinances. "Conservation subdivisions" represent subdivisions where the applicable provisions of the Zoning Ordinance have been modified in order to encourage flexibility of design so as to promote the most appropriate development of the land, to facilitate the adequate and economical provision of streets and utilities, and to preserve the natural and scenic qualities of open lands.
CONSTRUCTION PLANS
The maps and engineering drawings, described in Article VI of these regulations, accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with these regulations.
DRY HYDRANT
A hydrant installed for fire-fighting purposes which is not connected to a public water supply system.
EASEMENT
An authorization by a property owner or owners for restricted use by another person or body of any designated part of the owner's property.
ENGINEER or LICENSED PROFESSIONAL ENGINEER
A person licensed as a professional engineer by the State of New York.
FRONTAGE
The extent of a building or lot along an approved road or along a street to be built and dedicated as part of subdivision approval.
HIGHWAY SUPERINTENDENT
The Highway Superintendent of the Town of Pound Ridge, New York, or his duly authorized representative.
IMPROVEMENT
Includes but is not limited to the creation of new roads, building sites, public walkways, parks and recreation areas, water supply and waste disposal facilities as well as soil erosion and sediment control measures, landscaping and other means required to minimize or avoid impacts to the environment or to neighboring properties.
LAND EXCHANGE OR TRANSFER
A modification in lot lines such that the area exchanged or transferred is less than or equal to 10% of the minimum required lot area in the zoning district in which the affected lands are located.
LOT
A parcel of land not divided by roads.
MAINTENANCE BOND
A bond to assure the maintenance of required subdivision improvements following dedication of such improvements for such period as required by the Planning Board.
OFFICIAL MAP DATE
The map adopted and established by the Town Board under § 270 of the Town Law showing the location of roads, highways and parks and any amendments thereto adopted by the Town Board, or additions thereto resulting from the approval of subdivision plats by the Planning Board and the subsequent filing of such approved plats.
OFFICIAL SUBMISSION DATE
The date when a final subdivision plat application, including all other information required with that application, is received and determined to be complete by the Planning Board.
PERFORMANCE BOND
A bond, as required by § 277 of the Town Law, to assure the full and satisfactory completion of all required subdivision improvements as specified in the Planning Board resolution of approval, such bond to run for a term fixed by the Planning Board and with surety, form, sufficiency and manner of execution approved by the Town Board.
PLANNING BOARD
The Planning Board of the Town of Pound Ridge, New York.
PLAT or FINAL PLAT
A drawing, in final form, as described in § A117-14 of these regulations, showing a proposed subdivision and containing all of the information required by these or other applicable regulations and certified by a licensed surveyor or professional engineer.
PRELIMINARY PLAT
The preliminary drawing or drawings, described in § A117-13 of these regulations, showing the basic features of a proposed subdivision.
RESUBDIVISION
Any change of existing property lines or of property lines shown on a plat approved by the Planning Board and filed in the office of the County Clerk.
ROAD
An existing state, County or Town road or highway, a road shown upon a plat approved by the Planning Board, or a road shown on a plat duly filed and recorded in the office of the County Clerk.
ROAD, DEAD-END
A road or a portion of a road with only one point of vehicular traffic access.
ROAD RIGHT-OF-WAY WIDTH
The distance between property lines measured at right angles to the center line of the road.
ROAD WIDTH
The wearing or exposed surface of the road right-of-way designed to be used by vehicular traffic and measured perpendicular to the center line of such road.
SUBDIVISION
The division of any parcel of land, regardless of use, into lots, blocks, sites or parcels with or without the creation of new roads, for the purpose, whether immediate or future, of transfer of ownership or building development, and shall include resubdivision as defined herein.
TOWN ENGINEER
Any person either employed by the Town to provide professional engineering services or any consulting engineer retained to act in his or her place.
TOWN FLOOD DAMAGE PREVENTION LAW
Local Law No. 2-1987 of the Town of Pound Ridge, New York, providing for the regulation of activities in areas identified as subject to periodic flooding.[3]
TOWN PLAN OF DEVELOPMENT
The Comprehensive Plan for Development for the Town of Pound Ridge, New York, prepared and adopted by the Planning Board pursuant to § 272-a of the Town Law, and all amendments thereto.
WETLANDS PROTECTION AND PRESERVATION LAW
Local Law No. 1-1986 of the Town of Pound Ridge, New York, providing for the protection of wetlands, water bodies and watercourses, and all amendments thereto.[4]
ZONING ORDINANCE
The Zoning Ordinance of the Town of Pound Ridge, New York, and all amendments thereto.[5]
