The Sullivan County Legislature declares that
economic growth and development of new businesses, the provision of
employment opportunities and the fostering of existing businesses
and industry in Sullivan County is an important and necessary function
of government which will promote fiscal stability, a sound regional
economy and economic prosperity for the citizens of Sullivan County.
The purpose of this chapter is to authorize and endorse the preparation
of an application under the applicable provisions of Article 18-B
of the General Municipal Law for the designation by the State of New
York of certain areas hereinafter described as an "Empire Zone," and
to provide for the orderly and lawful administration thereof, in the
interests of the economic well-being and prosperity of Sullivan County.
The Sullivan County Legislature finds and declares the establishment
of an Empire Zone in Sullivan County as described herein to be in
harmony with the purposes of Article 18-B of the General Municipal
Law and of the Empire State Development Corporation.

A. The Sullivan County Legislature on behalf of Sullivan
County hereby authorizes the submission of an application to the New
York State Department of Economic Development for the establishment
of an Empire Zone on certain lands and properties located within Sullivan
County more specifically described in Schedule A annexed herein and
made a part hereof.
B. The Sullivan County Legislature on behalf of Sullivan
County hereby authorizes the submission of applications for regionally
significant projects, as defined in General Municipal Law § 957(d)(ii),
to the New York State Department of Economic Development for the establishment
of Empire Zone boundaries on certain lands and properties that are
located outside of the distinct and separate contiguous areas of the
Empire Zone boundaries within Sullivan County, being more specifically
described in Schedule B annexed herein and made a part hereof.
C. Regionally
significant projects.

(1) The
Sullivan County Legislature, on behalf of Sullivan County, hereby
authorizes the submissions of applications for the following regionally
significant projects:
(a) Ideal
Snacks, Corp. Village of Liberty Section 113. Block 3 Lot 1.1, Section
113. Block 1 Lot 10, Section 113. Block 2 Lot 2 and Section 113. Block
2 Lot 3.
(b) Boreal
Water Collection, Inc. Town of Thompson Section 9. Block 1 Lot 40.2
and Section 9 Block 1 Lot 41.
(c) Plastic
Technologies of Vermont, Inc./Plastic Technologies of New York. Town
of Thompson Section 31 Block 1 Lot 83.

(2) The
above parcels of real property more specifically described in Schedule
B annexed herein and made a part hereof.
There shall be a Local Empire Zone Certifying
Officer as required by law. The Commissioner of the Division of Planning
and Community Development shall serve as Local Empire Zone Certifying
Officer and shall be responsible for certifying that the business
applying for the Empire Zone certification is located within the boundaries
of the Empire Zone and is eligible to apply for tax benefits available
through the Empire Zone program. Said Certifying Officer may not serve
as a member of the Empire Zone Administrative Board.
There shall be an Empire Zone Administrative
Board as required by law. The members of the Administrative Board
shall be appointed by resolution of the Sullivan County Legislature.
The Administrative Board shall consist of at least nine members and
shall include an owner of a local business, a zone resident and a
representative of organized labor, a financial institution, a community
group, and an educational institution. The Chairman of the Board must
be an officer or employee of Sullivan County. The Administrative Board
shall develop the short- and long-term goals and objectives for zone
activities on an annual basis.
Pursuant to state environmental quality review
(SEQR) under the Environmental Conservation Law and 6 NYCRR Part 617,
the following determinations, findings and declarations are made:
A. The Sullivan County Legislature is the lead agency
for this project.
B. Under and pursuant to 6 NYCRR Part 617, this is a
Type I action.
C. The County of Sullivan has carefully considered, studied
and evaluated the impacts of this project.
D. The County of Sullivan has completed a full environmental
assessment form (EAF).
E. The County of Sullivan by its Legislature as lead
agency has found and hereby determined that the project will not result
in any large, important or significant impacts as determined under
applicable environmental review and therefore hereby issues a negative
declaration pursuant to 6 NYCRR Part 617. The Chairman of the Sullivan
County Legislature is authorized to execute any necessary documents
with respect hereto.
