The purpose of this article shall be to improve
and promote the health, safety and general welfare of the community
pertaining to traffic regulations at parking areas of shopping centers,
commercial sites and industrial sites.
The following words, when used in this article,
shall, for the purpose of this article, have the meanings ascribed
to them in this section:
An area designated for use by fire or other emergency vehicles
on any public or private street, driveway or parking area recognized
and designated as a "fire corridor." The fire corridor shall extend
from the curbline surrounding the building to the nearest traffic
lane or street. If no curbline exists from the building line, the
fire corridor shall be measured from the edge of the building walls
to the nearest traffic lane or street.
A traffic lane designated for use by fire or emergency vehicles
on any public or private street, driveway or parking area recognized
and designated as a "fire lane." Said fire lane shall extend from
the curbline surrounding the building. If no curbline exists from
the building line, said fire lane shall be measured from the edge
of the building walls.
The standing of a vehicle, whether occupied or not, other
than temporarily for the purpose of and while actually engaged in
loading or unloading.
Every natural person, firm, association or corporation.
Any stopping of a vehicle, whether occupied or not.
Every device in, upon or by which any person or property
is or may be transported or drawn upon a highway. Also included in
this definition are shopping carts, bicycles, motorbikes and other
similar vehicles and items.
A.
Shopping centers and commercial and industrial planned
unit developments.
(1)
The owners shall show fire lane widths of 30 feet
or an acceptable fire lane approved by the fire company in the district
in which the proposed construction is to be located. The width of
the fire lane shall be measured from the curbline around the perimeter
of the stores and buildings. If no curbline exists, the measured distance
shall be from the building line.
(2)
The plans shall be approved by the fire department
responsible for providing fire protection to the proposed development.
The recommendations from the fire company and the Town of Union Planning
Board shall be forwarded to the Town Board prior to the public hearing
approving the final development plan.
(3)
The owner of the development shall place adequate
signs and markings denoting fire lanes and areas in accordance with
the approved development plans. Said signs and markings shall be in
accordance with an approved Town form.
(4)
Pursuant to the authority granted under § 1660-a
of the Vehicle and Traffic Law of the State of New York, and in accordance
with the written request of the owner and/or owners, the Town of Union
Town Board does hereby authorize the Town Building Official, the Broome
County Sheriff's Department and the New York State Police to ticket
vehicles and other obstructions parked or placed in fire lanes or
areas of the following centers or commercial or industrial developments:
the list is kept on file at the Town of Union Planning Department.
(5)
The owners or their agents shall keep fire lanes and
areas clear of shopping carts, merchandise and other obstructions
which would hinder emergency vehicles and personnel access to the
fire lane and/or fire area.
(6)
The loading and/or unloading of merchandise is permitted
in the fire lane only when the driver of the vehicle is in attendance
at all times.
(7)
Existing planned unit developments may be continued,
though not conforming to the regulations of this article, until such
time as additions and/or alterations are proposed or the use changed.
At that time, provisions for approved fire lanes and fire areas shall
be provided and approved.
B.
Fire corridors in commercial and industrial districts.
(1)
A minimum of 10 feet in width shall be provided for
a fire corridor adjacent to all entrances of a commercial or industrial
building. This ten-foot corridor shall be provided to provide easy
access to the inside of the building by firemen and other emergency
personnel.
(2)
The owner may present to the Building Official a signed
and approved plan from the respective fire company permitting a deviation
from the standards above.
(3)
The owners and/or their agents shall keep fire corridors
clear of shopping carts, merchandise and other obstructions which
would hinder emergency vehicles and personnel access to the fire corridor.
(4)
The loading and unloading of merchandise is permitted
in the fire corridor only when the driver of the vehicle is in attendance
at all times.
