Pursuant to Chapter 679 of the Session Laws of the State of New York for the year 1970, which added § 1660-a to the Vehicle and Traffic Law of the State of New York, effective January 1, 1971, and entitled "Traffic regulations at hospital parking areas and driveways and shopping centers; private apartment complex," it is hereby resolved that pursuant to the written request of the owner of Southgate Plaza, Inc., the provisions of this article are enacted as the regulations of the Town of West Seneca for the control and operation of the parking area at Southgate Plaza, Inc.
All terms, such as "motor vehicle," as used in this article shall have the same meaning as they have in the Vehicle and Traffic Law of the State of New York.
A. 
Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop sign, but if none, then shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection, and the right to proceed shall be subject to the Subsection B hereof.
B. 
Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop as required above and, after having stopped, shall yield the right-of-way to any vehicle that has entered the intersection from another roadway or is approaching so closely on said roadway as to constitute an immediate hazard during the time when such driver is moving within or across the intersection.
The driver of a vehicle about to enter or cross a highway from any exit of Southgate Plaza shall yield the right-of-way to all vehicles approaching on said highway.
A. 
No person shall drive a motor vehicle at a speed greater than is reasonable and prudent under the conditions, having regard to the actual and potential hazards then existing.
B. 
No person shall drive a motor vehicle at a speed greater than 15 miles per hour.
No person shall stop, park or leave standing any vehicle, whether attended or unattended, upon any roadway within said plaza or in any area marked "fire lane" within said plaza.
Police shall have the power to order the removal and storage of vehicles parked or abandoned in the parking area during snowstorms, floods, fires or other public emergencies or found unattended in the parking area where they constitute an obstruction to traffic or where stopping, standing or parking is prohibited, and to assess against the owner of or operator of any such vehicle reasonable charges for such removal and storage.
The violation of any section of this article or of a rule or regulation provided herein shall constitute a traffic infraction within the meaning of § 1800 of the Vehicle and Traffic Law of the State of New York.
For the convenience of the public or of the users of the parking area, it shall be unlawful for any person to operate a vehicle in this plaza while said vehicle is unregistered or while the operator of said vehicle is unlicensed, pursuant to the terms of the Vehicle and Traffic Law of the State of New York, and while the vehicle is not equipped in a manner prescribed by the Vehicle and Traffic Law of the State of New York, and a violation of any of the rules and regulations of the Vehicle and Traffic Law of the State of New York pursuant to the above shall constitute a violation of this section.
It shall be unlawful to operate a motor vehicle in said plaza during the hours of darkness without having the headlights of said vehicle on.
