Pursuant to the authority of § 1660-a
of the Vehicle and Traffic Law of the State of New York and upon the
written request of the owner or person in charge of the operation
and control of the French Quarter Mobile Home Park, the provisions
of this article are enacted as the regulations of the Town of West
Seneca for the control of and operation of parking areas and driveways
of the French Quarter Mobile Home Park.
A.
FRENCH QUARTER MOBILE HOME PARK
As used in this article, the following terms shall
have the meanings indicated:
The drives and parking areas within said Park, including
streets named by the Park as Versailles Boulevard, Burgundy Circle,
Avignon Court, Calais Court, Orleans Court, Bordeaux Court, Torraine
Court, Normandy Court, Marsaille Avenue, Alsace Place, Lorraine Place,
Doucette Place, Britanny Court and Bourbon Court.
B.
All terms, such as "motor vehicle," as used in this
article shall have the same meaning as they have in the Vehicle and
Traffic Law of the State of New York.
A.
Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop sign; but if none, then he shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, at the point nearest the intersection roadway where the driver has a view of the approaching traffic on the intersecting roadway before entering the intersection, and the right to proceed shall be subject to Subsection B hereof.
B.
Except when directed to proceed by a police officer,
every driver of a vehicle approaching a stop sign shall stop as required
above and, after having stopped, shall yield the right-of-way to any
vehicle that has entered the intersection from another roadway or
is approaching so closely on said roadway as to constitute an immediate
hazard during the time when such driver is moving within or across
the intersection.
The driver of a vehicle about to enter or cross
a highway from any exit of the Park shall yield the right-of-way to
all vehicles approaching on said highway.
No person shall stop, park or leave standing
any vehicle, whether attended or unattended, upon any roadway within
said Park in any area marked "NO PARKING" or "FIRE LANE." There shall
be no parking on any roadways in the Park from 11:00 p.m. to 7:00
a.m. from November 15 to March 15.
Police shall have the power to order the removal
and storage of vehicles parked or abandoned in the parking area during
snowstorms, floods, fires or other public emergencies or found unattended
in the parking area where they constitute an obstruction to traffic
or where stopping, standing or parking is prohibited and to assess
against the owner of or operator of any such vehicle reasonable charges
for such removal and storage.
The violation of any section or of a rule or
regulation provided herein shall constitute a traffic infraction within
the meaning of § 1800 of the Vehicle and Traffic Law of
the State of New York.
For the convenience of the public or of the
users of the Park, it shall be unlawful for any person to operate
a vehicle in said Park while said vehicle is unregistered, uninsured
or while the operator of said vehicle is unlicensed, pursuant to the
terms of the Vehicle and Traffic Law of the State of New York, and
while the vehicle is not equipped in a manner prescribed by the Vehicle
and Traffic Law of the State of New York, and a violation of any of
the rules and regulations of the Vehicle and Traffic Law of the State
of New York pursuant to the above shall constitute a violation of
this section.
It shall be unlawful to operate a motor vehicle
in the Park during the hours of darkness without having the headlights
of said vehicle on.
