[HISTORY: Adopted by the Borough Council of the Borough of Ephrata 4-18-1966 as Ord. No. 855. Amendments noted where applicable.]
The Borough Council hereby authorizes and designates the Library to act as the legal agent of Ephrata Borough to provide public library service to the residents and taxpayers of the borough for and on behalf of Ephrata Borough.

The Borough Council hereby agrees to maintain or assist in the maintenance of the Ephrata Public Library in accord with the provisions of Section 401 of the Library Code, the Act of June 14, 1961, P.L. 324,[2] and at a level of financial support that will ensure that the Library will be able to qualify annually for state financial aid in accord with Section 303(1) of the Library Code.[3]

In accord with Section 411 of the Library Code,[1] the Borough Council and Mayor shall appoint four (4) people to serve as its representatives on the Board of Directors of the Ephrata Public Library, each representative to serve three (3) years, the terms to expire in different years. Subsequent vacancies are to be filled by people appointed by the Mayor and Council.

In accord with Section 412 of the Library Code,[1] the Treasurer of the Board of Directors of the Library shall give bond to the municipality with satisfactory surety in such amount as the Board of Directors of the Library may determine.

In accord with Section 413 of the Library Code,[1] the Board of Directors of the Library shall present a financial report to Ephrata Borough annually, and Ephrata Borough shall arrange to have the accounts of the Treasurer of the Board of Directors of the Library audited annually as in the case of other municipal expenditures.

The Board of Directors of the Library shall prepare and present to Ephrata Borough such reports as are required by Section 414 of the Library Code,[1] and shall give free library service to the residents and taxpayers as provided in Section 415 of the Library Code.[2]
