GARBAGE
PERSON
RUBBISH and TRASH
The following words and terms, as used in this chapter,
shall have the meanings hereby respectively ascribed thereto:
All table refuse, animal and vegetable matter, offal from meat, fish
and fowls, fruits, vegetables and parts thereof, and other articles and materials
ordinarily used for food which have become unfit for such use or which are
for any reason discarded.
Any natural person, partnership, association, firm or corporation.
All matter and materials which are discarded or rejected by the owners
or producers thereof as offensive or useless or which by their presence or
accumulation may injuriously affect the health, comfort and safety of the
community, except garbage and body waste.

In this chapter, the singular shall include the plural,
the plural shall include the singular, and the masculine shall include the
feminine and the neuter.
A.Â
No garbage shall ever be burned within the borough limits.
B.Â
No rubbish or trash shall be burned which produces an
offensive smoke or odor.
C.Â
No fire shall be kindled or maintained in damp, cloudy,
foggy or windy weather or at any time between 7:00 p.m. or sunset, whichever
occurs first, and 7:00 a.m.
D.Â
No open fires shall be permitted anywhere in the borough.

Burning shall be permitted in suitable fireproof containers
or enclosures if at a distance of at least ten (10) feet from any building.
F.Â
In industrial and commercial areas, burning shall be
permitted within ten (10) feet of a building if the fire is contained in an
incinerator of masonry which is properly constructed with fire brick and has
a properly constructed chimney of sufficient height so as not to produce gases
objectionable to adjoining property owners.
The enforcement of this chapter shall be the responsibility of the Police
Department, the Fire Chief and the Code Enforcement Officer, each of whom
shall have the power to act on his or her own.
Any person who shall violate any provision of this chapter or any order
issued thereunder shall, upon conviction thereof, be sentenced to pay a fine
of not more than six hundred dollars ($600.) and costs of prosecution and,
in default of payment of such fine and costs, to imprisonment for not more
than thirty (30) days. Every day that a violation of this chapter continues
shall constitute a separate offense.
