A. 
Ephrata Borough will provide sanitary sewer service to areas beyond the Borough limits under the terms hereinafter established:
(1) 
To provide sanitary sewer services at its trunk, interceptor or other collector sewer lines for the property owner, said sewage to be delivered through property owner lateral or other approved collection pipes at an entrance fee as set forth in the fee schedule established from time to time by resolution of the Borough Council.[1] This provision is to apply to each individual improvement on a parcel of land to be provided sanitary sewer service.[2]

(2) 
Every connection of service made must be registered with the Borough through an application for a sewer permit and receive inspection by the Borough in conformance with the Borough Plumbing Code.

(3) 
Every sanitary sewer placed in public rights-of-way, private rights-of-way or extended to serve more than one property owner shall be at least eight inches in size and be considered a public trunk sewer for extension to the system, unless otherwise approved by the Borough Manager (i.e., grinder pump systems).

(4) 
Every trunk sewer line and right-of-way shall be dedicated to the Borough for public use and subsequent municipal maintenance by either a plan of record or a document of record.
(5) 
Every trunk sewer line and lateral shall be inspected by a Borough inspector at the property owner's expense.
B. 
The property owner shall install at his or her expense a properly sized water meter, with remote reader, connected to his or her total water supply which serves the facility connected to the sanitary sewer system, which shall be purchased from the Borough at the current price.
C. 
The property owner shall extend a lateral line or sewer trunk line in a manner approved by the Borough and Pennsylvania Department of Environmental Resources regulations to a point on an existing trunk or interceptor line designated by the Borough in accordance with a plan prepared by a registered professional engineer and approved by the Borough and subsequently permitted by the Pennsylvania Department of Environmental Resources; a copy of the as-built plans and lateral location shall be filed with the Borough.
D. 
Rates.
(1) 
The property owner shall pay a service charge for each domestic or equal service. The charge for sewage treatment for customers outside the Borough limits shall be based on water consumption in accordance with the sewer rents set forth in § 259-7 of Article II of this chapter.[3]

(2) 
Rates are subject to change by councilmanic action.
(3) 
The property owner agrees that failing to make regular payments to the Borough for service will constitute a breach of contract and give the Borough the right to discontinue service and/or enter a municipal lien against the property or use other legal means to collect the same.
E. 
The property owner agrees to abide by the regulations of the Plumbing Code of the Borough of Ephrata[4] and the regulations of the Pennsylvania Department of Environmental Resources, whether now in force or hereafter to be adopted, and further agrees not to allow injurious material to be discharged into the sewer system.

F. 
The property owner shall enter into an agreement for providing public improvements, including a construction bond or escrow account equal to 110% of the amount of sewer construction cost or an amount determined by the Borough unless construction of the sewer trunk line is completed prior to the sale of any lot or lots.[5]

G. 
The property owner agrees to obtain a sewage connection or permit from the Borough prior to individual lateral hookup. During the planning and construction process for increase in treatment plant size, the Borough shall determine at the beginning of each calendar year the limit of sewer connections to be permitted for the ensuing year.[6]

Commercial and industrial tracts of a subdivision within the Borough shall be charged an entrance connection fee to the sanitary sewer system as set forth in the fee schedule established from time to time by resolution of the Borough Council.[2] All other requirements of the Borough pertaining to sanitary sewerage shall apply.

Future action of a township in which service has been provided by the Borough of Ephrata by agreement shall not change any part of the agreement entered as by the Borough, township and property owner without specific approval of Ephrata Borough Council. Nothing in an agreement with a property owner in a township shall abrogate any additional charges or regulations adopted by the Supervisors of that township.
