Editor’s Note: This ordinance also provided again for the repeal of former Art. I, Controller, adopted 3-17-1954, amended in its entirety 5-14-1985 by Ord. No. 800, which was originally repealed 3-17-2014 by Ord. No. 1001, both of which ordinances indicated that the office would continue until the end of the Controller’s current term, 12-31-2015.
The Borough Council shall appoint, by resolution, in accordance with the Pennsylvania Borough Code, 8 Pa.C.S.A. § 1005, an independent auditor who shall be a certified public accountant, registered in Pennsylvania; a firm of certified public accountants so registered; or a competent public accountant or a competent firm of public accountants, and shall, annually, require the appointed auditor to make an independent examination of the accounting records of Morrisville Borough for the fiscal year. Said appointed auditor shall perform the other duties and exercise the powers as conferred upon the independent auditor pursuant to 8 Pa.C.S.A. § 1041.

The Office of Borough Manager is hereby created by the Borough.
The Manager shall be appointed by the Council. The Manager shall serve at the pleasure of Council and may be removed at any time by Council.

The Manager shall be chosen solely on the basis of executive and administrative abilities, with special reference to actual experience in or knowledge of accepted practices in respect to the power and duties of the Office as herein outlined. The Manager need not be a resident of the Borough or of the State of Pennsylvania.

Before commencing duties as stated in § 65-8, herein, the Manager shall be bonded with a bonding company as surety, to be approved by Council, in an amount as determined by Council, conditioned for the faithful performance of the Manager's duties. The premium shall be paid by the Borough.
The salary of the Borough Manager shall be fixed from time to time by ordinance.
A. 
The Manager shall be the Chief Administrative Officer of the Borough and shall be responsible to Council as a whole for the proper and efficient administration of the affairs of the Borough. The Manager's powers and duties shall relate to the general management of all Borough business not expressly by statute imposed or conferred upon other Borough officers.
B. 
Subject to recall by ordinance of Council, the powers and duties of the Borough Manager shall include the following:
(1) 
The Manager shall supervise and be responsible for the activities of all municipal departments.
(2) 
The Manager shall hire and, when necessary for the good of the Borough, shall suspend or discharge all employees under the Manager's supervision, provided that persons covered by the Civil Service provisions of the Borough Code shall be hired, suspended or discharged in accordance with such provisions. The Manager shall report, at the-next meeting thereafter of Council, any action taken by authority of this subsection.
(3) 
The Manager shall prepare and submit to Council before the close of the fiscal year, or on such alternate date as Council shall determine, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager shall obtain from the head of each department, agency, board or officer, estimates of revenues and expenditures and other supporting data. The Manager shall review such estimates and may revise them before submitting the budget to Council.
(4) 
The Manager shall administer the budget after its adoption by Council.
(5) 
The Manager shall hold such other municipal offices or head one or more of the municipal departments as Council may from time to time direct.
(6) 
The Manager shall attend all meetings of Council and its committees with the right to take part in the discussion and the Manager shall receive notice of all special meetings of Council or its committees.
(7) 
The Manager shall prepare the agenda for each meeting of Council and said agenda shall be submitted to all Council members at least three days prior to the meeting and said agenda shall not be changed within three days of said meeting.
(8) 
The Manager shall keep the Council informed as to the conduct of Borough affairs, submit periodic reports on the condition of the Borough finances and such other reports as Council requests and make such recommendations to Council as the Manager deems necessary.
(9) 
The Manager shall submit to Council, as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
(10) 
The Manager shall see that the provisions of all franchises, leases, permits and privileges granted by the Borough are observed.
(11) 
The Manager shall employ, with the approval of Council first obtained, experts and consultants to perform work and to advise in connection with any of the functions of the Borough.
(12) 
The Manager shall attend to the letting of contracts in due form of law, and supervise the performance and faithful execution of the same, except insofar as such duties are expressly imposed upon some other Borough officer by statute.
(13) 
The Manager shall ensure that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all the Borough's claims.
(14) 
The Manager shall be the purchasing officer of the Borough and, in accordance with the provisions of the Borough Code of Council, purchase all supplies and equipment for the various agencies, boards, departments and other offices of the Borough.
(15) 
The Manager shall keep an account of all purchases and shall, from time to time, or when directed by Council, make a full written report thereof. The Manager shall also issue rules and regulations, subject to approval of Council, for requisitioning and purchasing of municipal supplies and equipment.
(16) 
The Manager shall investigate all complaints regarding services or personnel and report thereon to Council.
(17) 
The Manager shall perform such other duties as may from time to time be directed by Council.
Neither the Council nor any of its members shall dictate or attempt to dictate the hiring of any person or the discharge of any person from employment by the Borough except as required to do so by the Civil Service provisions of the Code. Except for the purpose of inquiry, the Council and its members shall deal with the administrative service solely through the Borough Manager and neither Council nor any of its members shall give orders publicly or privately, to any subordinates of the Manager.
If the Manager becomes ill or needs to be absent from the Borough, the Manager shall designate one qualified staff member to perform the duties of the Manager during the Manager's absence or disability. The designated staff person shall not perform these duties for a period longer than two weeks without the approval of Council.
