A. 
Except where the context clearly indicates a different meaning, the following words when used in this article shall have the following meanings:
BOROUGH
The Mayor and Borough Council of the Borough of Morrisville and those persons authorized to act on their behalf.
GRADE
A sidewalk grade.
MORRISVILLE
Those land areas within which or as to which the Borough has power to act.
STREET
A public thoroughfare of Morrisville, including any proposed thoroughfare and any state highway.
SIDEWALK
That portion of a street set aside or designated by the Borough for pedestrian traffic.

The singular of all words include the plural and the masculine includes feminine and neuter.

The purpose of this article is to vest in the Borough the full power to compel owners of realty to construct, repair and maintain sidewalks and curbs within Morrisville, where the ordinance establishing grade failed to provide specifically for such said power, as if such said power were contained in the original ordinance establishing grade; and to provide a uniform basis for the construction, repair and maintenance of sidewalks and curbs on streets in Morrisville, heretofore or hereafter proposed, opened or established.
A. 
The owner of any lot fronting on any street upon which a grade has been or shall hereafter be established shall upon receipt of 30 days' written notice from the Borough, construct, or cause the construction of, the sidewalk and curb in front of and along the lot and on a street, or perform, or cause the performance of, repair of the same, in accordance with the direction received and in accordance with the provisions and specifications hereinafter contained or referred to.
B. 
Upon failure of any owner of a lot to comply with the terms of the written notice sent within 30 days of receipt thereof, the Borough may at any time thereafter, and without further notice, enter upon and construct or repair the sidewalk and curb and enter the cost thereof, together with a 10% additional, together with all charges and expenses, as a municipal claim or lien, and/or collect the same by action in assumpsit.
C. 
No owner shall be caused to construct the curb or sidewalk contained within the curve of the radius of the intersection of two curb lines.
D. 
Nothing hereinbefore or hereafter contained in this article shall be construed as acceptance or opening of any portion of any street for pedestrian travel.
A. 
All sidewalks and curbs shall be constructed and maintained in conformity with the grade established by the Borough, for which grade application must be made to the Borough.
B. 
In all streets where the width of the sidewalk is not fixed by ordinance, the width of the sidewalk area shall be 1/5 part of the total width of the street, from the property line outside of the curb, on each side of the street.
C. 
Where one curb line intersects another curb line the said curb lines shall be connected with a circular curbing of a radius not less than eight feet, the curbing to be set to a true tangent with curb lines in all cases. Also, where an angle occurs in a line, the lines forming the angle shall be connected by a curve of a radius approved by the Borough.
D. 
The minimum width of the paved portion of any sidewalk shall in no case be less than five feet. The sidewalk shall be paved for the full width when the Borough shall so require.
E. 
If the sidewalk is not paved the full width, the space remaining unpaved must be filled to grade with good gravel or sodded, and in either case shall be maintained.
F. 
The pavement of the sidewalk must be so constructed that the middle line of the paved portion shall coincide with an imaginary line drawn parallel with the outside line of the curb at a distance equal to 1/2 of the total width of the sidewalk; and in no case shall it be laid otherwise, except upon good cause shown, as uniformity of sidewalks along a street, and written permission therefor obtained from the Borough.
In addition to the general specifications, the Borough shall, by motion adopted by Council, enact and adopt further specifications as to materials and methods to be used in construction or repair and not specifically detailed herein, but not in conflict with anything stated herein, and to be enforced as a part of this article, which said further specifications shall be reduced to writing and kept open for public inspection, together with this ordinance, at the office of the Borough Secretary or Manager.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, together with costs of prosecution, or to imprisonment for a term not to exceed 30 days. Every day that a violation of this article continues shall constitute a separate offense.
