In accordance with Article
VII, Section 2(a), of the City Charter, there is hereby established a Legal Department.
It shall be the function of this Department:
A. Draft ordinances. To draft any ordinances when required
by the City Council or City Manager.
B. Draft bonds. To draft all bonds, deeds and other instruments
which may be required of this Department by any ordinance, resolve
or order and which, by law, usage or agreement, are to be drawn at
the expense of the City.
C. Defend City. To defend all actions and suits against
the City, or any officer of the City, wherein and whereby any of the
estates, rights, privileges, ordinances, resolves, orders or acts
of the City government, or any branch thereof, may be brought in question
before any court in this state.
D. Prosecutions. To commence and prosecute any suit on
account of any estates, rights, privileges, claims or demands of the
City whenever directed, in writing, by the Chair of the Council and
the City Treasurer.
E. Furnish opinion. To furnish the City Council, or any
committee thereof, with opinion on any legal subjects which may be
requested by said bodies and render professional advice to any officers
of the City government who may require legal opinions touching the
duties of their respective offices.

There is hereby authorized and established the
position of City Solicitor. The City Solicitor shall supervise the
entire operation of the Legal Department. This position shall not
be included in the Personnel Classification and Compensation Plan
for the City of Bangor. The City Solicitor shall be appointed by the
City Council.
A. Engage additional counsel. Whenever, in the opinion
of the City Council, it may become necessary to have the aid of additional
counsel, such counsel may be engaged at the expense of the City.
B. Monthly report to City Manager. The City Solicitor
shall make a report to the City Manager, before the first Council
meeting of each month, as to the business of their office during the
preceding month.
C. Other duties. The City Solicitor shall do all and
every professional act incident to the office or which may be required
of them by the City government, or any special committee thereof,
or any ordinance, resolve or order of the Council.
