This article shall be known and may be cited as the "City of Bangor Ordinance Regulating the Operation of Human-Propelled Conveyances."
For purposes of this article, the following words shall have the following meanings:
CITY
The City of Bangor.
DOWNTOWN DEVELOPMENT DISTRICT (DDD)
That portion of the City of Bangor designated as the "Downtown Development District" (DDD) in Chapter 165, Land Development, of the Code of the City of Bangor and in the Zoning Map of the City of Bangor, as they may be amended from time to time.
HUMAN-PROPELLED CONVEYANCE
Every device used for the propulsion of people by human power, not subject to registration under state motor vehicle laws, which contains one or more wheels, tracks or other mechanical or operational devices, whether in a single unit or not, including but not limited to bicycles, scooters, skateboards, air-cushioned skateboards, roller skates, roller blades or cross-country training skis capable of being propelled at a speed exceeding three miles per hour. This term does not include any device operated by a person, or a person directly assisting a person, who is unable to walk or otherwise ambulate without the assistance of a human-powered conveyance.
OPERATE
To ride upon, drive, propel or otherwise convey oneself or others by the use of a human-propelled conveyance.
VEHICLE
Any human-propelled conveyance.
No person shall operate a human-propelled conveyance on any street, sidewalk or other public way, as that term is defined at 17-A M.R.S.A. § 505, as amended, in any portion of the City designated as the Downtown Development District, except that bicycles may be operated on such streets and public ways, subject to state motor vehicle law restrictions.
A. 
No person shall operate a bicycle on any sidewalk in any portion of the City; provided, however, that children 12 years old and younger operating bicycles with tandem wheels of sixteen-inch diameter or less may operate their bicycles on sidewalks outside the Downtown Development District.
B. 
No person shall operate a bicycle in any City park, as designated in Chapter 231, Public Parks, § 231-2 of this Code, located in any portion of the Downtown Development District.
C. 
No person shall ride a bicycle while passing in, through, along or across any highway, street, way, lane, common, square or alley in the City at an immoderate rate, and no person shall ride a bicycle within the City limits in the nighttime, after 30 minutes after sundown, unless such bicycle is provided with a suitable lamp, properly lighted.

This Article VI does not apply to members of the Bangor Police Department or the Bangor Fire Department while in the performance of their duties.
Violation of this article may be punishable by a civil penalty of not less than $50 and not to exceed $200 or by impoundment of the vehicle which was operated in the commission of such violation for a period not to exceed 30 days, or both.
