The purpose of this article is to establish
regulations to ensure the safety of pedestrians and motorists when
using the public ways in the City. It is a further purpose of this
article to provide ways for pedestrians to cross public ways with
a reasonable degree of safety without causing unreasonable delay to
the movement of motor vehicle traffic.
Definitions of terms used in this article shall
be as defined in 29-A M.R.S.A. § 101, the Maine Motor Vehicle
Statutes.
A.
No operator of a motor vehicle shall fail to stop
for any pedestrian who is in a crosswalk.
B.
No operator of a motor vehicle may pass or overtake
a vehicle which is stopped for a pedestrian in a crosswalk.
C.
Pedestrians crossing any public way must yield to
all traffic unless they are within a crosswalk.
D.
Pedestrians must step off the sidewalk and into the
crosswalk to signal to motor vehicle operators that they intend to
use the crosswalk.
E.
Pedestrians may not enter a crosswalk so that they
obstruct a travel lane, if there is not enough time for oncoming traffic
to yield in a safe and reasonable manner.
F.
Pedestrians at a crosswalk that has working pedestrian
traffic control signals may only enter the crosswalk when the "Walk"
word or symbol is displayed. Any pedestrian in a crosswalk when the
pedestrian traffic control signal changes to "Don't Walk" may continue
to the next sidewalk or safety island.
A.
Any person accused of a violation of any portion of this article will be issued a notice of violation. Within 30 days of the issuance of the notice of violation the person accused may voluntarily waive their right to appear and defend before any court the charge made against them for such violations by paying to the municipality 1/2 of the fine indicated in § 291-64A or B of this article.
B.
If the waiver fee has not been paid within 30 days,
then the Police Department or Legal Department will file the necessary
paperwork with the court to request a hearing.
