[Adopted 5-22-1979 by Ord. No. 369-79 (Art. II of Ch. 13 of the 1966 Code of the Township of Brick)]
No person shall continuously occupy any boat which is anchored, moored or tied up in any waterway within the Township of Brick from the hours of 12:01 a.m. to 6:00 a.m., except as follows:
A. 
Where such boat is anchored, moored or tied up within the limits of a commercial marina which is served by a sewage or septic facility, which facility meets all governmental requirements and where an operational toilet is available within the limits of such marina during the hours aforesaid.
B. 
Where such boat or vessel is anchored, moored or tied up immediately adjacent to a dock which abuts a lot, which such lot is served by a sewage or septic facility, which such facility meets all governmental requirements and where an operational toilet is located on such lot during the hours aforesaid.

No person shall store, leave or otherwise allow for a boat to occupy any real property in any of the following circumstances:
A. 
When the placement of the boat obstructs vehicular vision or otherwise impedes or impairs the safe flow of traffic.
B. 
The boat is unregistered.
C. 
The boat is unseaworthy.
D. 
The boat is placed upon a vacant lot.
E. 
The boat does not belong to the owners and occupants of the dwelling which is located on said property.
F. 
The boat does not belong to the owners and occupants of a dwelling located immediately adjacent to a vacant lot upon which the boat is located and which vacant lot is used in conjunction with the lot upon which the boat owner's dwelling is located.

No person shall utilize, maintain or operate any boat or other floating or water-going device with a combustion motor and/or gas- or petroleum-fuel-driven motor upon any fresh water body located within the Township of Brick. For the purpose of this section, this shall not apply to the body of water known as Forge Pond.

Any person convicted of a violation of this article shall be subject to the penalties as provided in Chapter 1, § 1-15, General penalty. Each day during which a violation of this article shall occur shall be deemed a separate violation.
