There are hereby established in the Township of Brick rules
and regulations regarding taxicabs and limousines.

As used in this chapter, the following terms shall have the
meanings indicated:
LIMOUSINES
Any automobile or motor car used in the business of carrying
passengers for hire to provide prearranged passenger transportation
on a dedicated, nonscheduled, charter basis that is not conducted
on a regular route and with a seating capacity of no more than 14
passengers, not including the driver, and which charges a premium
fare or price agreed upon in advance.
OPERATE
Having a place of business, office, dispatcher location or
storage yard for limousines or taxicabs within the Township of Brick
or accepting passengers from points within the Township.
PRINCIPAL PLACE OF BUSINESS
The location of the main place of business of the taxicab
or limousine service where the service is conducted, where taxicabs
or limousines are dispatched, and where drivers report for duty. A
zoning permit is required for the establishment of a principal place
of business with the Township of Brick.
TAXICABS
Any vehicle propelled by mechanical motor power, engaged
in the business of transportation of passengers for hire or pay within
the Township, either operated from stands in the public street or
public place, or on telephone calls to a central office, or in any
manner within the previous 24 hours. In order to qualify as a taxicab,
a vehicle must have a minimum wheel base of 100 inches and not exceed
15 years in age. Specifically excluded from this definition are vehicles
bearing livery and limousine plates which are transporting, pursuant
to a prearranged written contractual agreement, persons to points
within the Township for weddings, funerals and other similar occasions,
and at no time will a vehicle bearing livery or limousine license
plates be substituted for a taxicab.
The licensing of taxicabs and limousines shall be by the Township
and such licenses when granted by the Township Council shall be countersigned
by the Municipal Clerk. All fees shall be paid to the Municipal Clerk.
A. Taxicabs. The regulating and inspection of taxicabs, the application
for a license to operate taxicabs, the licensing of drivers as provided
for in this chapter and the enforcing of the provisions of this chapter
shall be by procedures set forth by the Municipal Clerk. The approval
of a license application shall be made upon approval of the Municipal
Clerk.
B. Limousines. The application for a municipal license to operate a
limousine service from within the Township of Brick shall be made
to the Municipal Clerk who shall also verify compliance with requirements
as set forth by state law. The approval of a verified license application
shall be made upon approval of the Municipal Clerk.

No person, partnership or corporation shall operate a taxicab
or limousine service within the Township without first having obtained
a license for that purpose.
