[Adopted 12-18-1995 by Ord. No. 753 as Sec. 21-1 of the 1995 Revised General Ordinances; amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. II)]
As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
Beverage containers, excluding aluminum foil, aluminum trays and any other type of aluminum.
AUTOMOTIVE BATTERIES
Any vehicle battery.
BRUSH
All brush, branches and shrubs except for roots.
CONSTRUCTION /DEMOLITION DEBRIS
Recyclable components of the construction/demolition debris waste stream, including but not limited to concrete, brick, block, asphalt, asphalt-base roofing scrap and tree stumps/trunks. Additional recyclable components of the construction and demolition debris waste stream will be included as markets are found.
CORRUGATED
A heavy-duty shipping box material displaying in cross section a rippled center layer, excluding detergent, cracker and cereal boxes and similar consumer packaging.
FERROUS AND NONFERROUS SCRAP METALS
Scrap metal other than household appliances, including steel, cast iron, aluminum, brass, fencing and yard equipment.
GLASS
Clear, green and brown food and beverage containers only.
GRASS
Grass clippings collected after lawn mowing, exclusive of other vegetative trimmings.
HIGH-GRADE WASTEPAPER
Office waste; computer forms.
HOUSEHOLD APPLIANCES
Stoves, washers, dryers, dishwashers, water heaters, refrigerators, sinks, tubs and freezers and all other items of a similar nature.
LEAVES
Fallen leaves.
MIXED PAPER
Magazines, junk mail and unsoiled scrap.
NEWSPAPER
Papers of the type commonly referred to as "newsprint"; may include periodicals, advertising supplements; does not include books, paper bags and such other paper products of every nature.
PERSONS
All individuals, partnerships, corporations, owners, tenants, lessees, occupants, associations and organizations residing, owning or operating, managing, leasing or occupying any premises or business, commercial or industrial, within the Township and served by municipal or other solid waste collection service.
PLASTICS
Plastic soda bottles, milk jugs, HDPE and PET.
TIN AND BIMETAL CANS
All metal containers other than aluminum, including paint cans and spray cans.
TIRES
New and used tires from vehicles owned and used by residents for private transportation, not business purposes.
USED ENGINE OIL
Used engine oil drained during routine maintenance from vehicles owned and used by residents for private transportation, not business purposes.
VEGETATIVE WASTE
Plant growth (i.e., flowers, garden waste, etc.)
The following are designated as recyclable material for premises in the Township:
A. 
Residential: newspaper, glass food and beverage containers, aluminum beverage containers, tin and bimetal cans, plastic containers, corrugated, mixed paper, white goods, ferrous and nonferrous scrap metals, construction/demolition debris, tires, motor oil, automotive batteries, leaves, grass, brush and vegetative waste.
B. 
Commercial: newspaper, glass food and beverage containers, aluminum beverage containers, tin and bimetal cans, high-grade paper, mixed paper, corrugated, ferrous and nonferrous scrap metals, construction/demolition debris, tires, motor oil, automotive batteries, plastic containers and film (PET, HPED and PVC), leaves, grass, brush and vegetative waste.
C. 
Institutional: newspaper, glass food and beverage containers, aluminum beverage containers, tin and bimetal cans, high-grade paper, mixed paper, corrugated, ferrous and nonferrous scrap metals, construction/demolition debris, tires, motor oil, automotive batteries, plastic containers and film (PET, HPED and PVC), leaves, grass, brush and vegetative waste.
Each designated recyclable shall be prepared by each person in the manner hereinafter described prior to leaving the same at the recycling center or placing at curbside.
A. 
Newspapers. Newspapers shall be tied in bundles no more than 12 inches high or shall be placed in paper grocery bags. Packaging in plastic bags is not permitted.
B. 
High-grade wastepaper. High-grade wastepaper shall be placed in paper grocery bags or in such other designated receptacle as shall be acceptable to the Township Recycling Coordinator.
C. 
Corrugated. Corrugated shall be cut and folded to reduce volume as much as possible and tied with cord in bundles no greater than 12 inches in height.
D. 
Glass. Glass shall be thoroughly rinsed to remove all beverage/food residue and waste; caps shall be removed. Labels may remain on the glass. Glass shall be placed in paper grocery bags or such other designated receptacle as shall be acceptable to the Township Recycling Coordinator.
E. 
Aluminum cans. Aluminum cans shall be thoroughly rinsed to remove all beverage food residue and waste, and shall be placed in paper grocery bags or such other designated receptacle as shall be acceptable to the Township Recycling Coordinator.
F. 
Leaves. Leaves shall be source-separated and prepared for collection and composting as directed by the Township's Department of Public Works.
G. 
Grass and vegetative waste. Residents who care for their own lawns and wish these items removed shall place them in paper biodegradable bags only. Bags will be picked up according to a schedule posted in the recycling brochure each year. Landscapers and/or lawn service workers who trim lawns at residential, commercial, industrial and institutional sites with the Township may deliver these items to the designated area of the Little Falls Recycling Center in accordance with the Township's established policies.
It shall be mandatory for all persons to separate designated recyclables from their household or business waste. This material must be separated and collected for recycling in one or more of the following manners:
A. 
Residents shall bring their separated recyclables to the Little Falls Recycling Center, or such other place as may be designated by resolution of the governing body, and leave the same in the appropriate designated depositories. It shall be unlawful to leave any material other than the appropriately designated recyclable material in such depositories.
B. 
Residents shall separate recyclables from their household waste and leave the same at curbside in a reusable container or other designated receptacle on the designated collection day for pickup by the Township. All recyclables must be separated by type for individual collection. It shall be unlawful to place recyclables at curbside at any other time than those times which are designated by resolution of the governing body. Boxes and other containers will be left for reuse by residents. From the time of placement at the curb by any person of any designated recyclable material for collection by the Township, in accordance with the terms hereof, such material shall be and become the property of the Township or its authorized agent, and it shall be a violation of this article for any person not expressly authorized by the Township to collect or pick up or cause to be picked up any such recyclables. Each collection in violation hereof from one or more residences shall constitute a separate and distinct offense punishable as hereinafter provided.
C. 
Commercial, industrial and institutional establishments, residential complexes and office buildings or mixed-use commercial/office complexes having private garbage pickup contacts may make their own recycling arrangements, but must provide the Recycling Coordinator yearly with documentation proving, in a form acceptable to the State Office of Recycling, compliance with the requirements of the statutes and this article. If the management of any such building or complex shall provide centralized private garbage collection service, it shall similarly provide for centralized collection, marketing and documentation of recyclable materials. The due date for this yearly documentation is January 30 for the prior year.
D. 
Solid waste haulers and recycling markets or services collecting recyclables within the Township by private contract with institutional, residential or commercial sources shall be required to register with the office of the Recycling Coordinator and to submit yearly receipts or other documentation acceptable to the State Office of Recycling to prove the quantity of material recycled.
E. 
It shall be mandatory and a condition precedent to the issuance of any permanent certificate of occupancy or final work inspection for the owner of such property to recycle all applicable construction/demolition debris components and to provide written proof of same in accordance with this subsection to the Building Department for transmittal to the Recycling Coordinator. Written documentation of the tonnage of material recycled under this subsection shall be made by accurate weight slips and/or in such form as is required by the Recycling Coordinator and as will satisfy state requirements for municipal eligibility for state tonnage grants.
F. 
Each collection in violation of these provisions from one or more collection sources shall constitute a separate and distinct offense punishable as hereinafter provided.
This article is in no way intended to prohibit separate newspaper drops or other recycling drives by volunteer or charitable organizations approved by the Township on days other than those designated for collection by the Township. Such an organization must get a written permit from the Township Clerk's office prior to conducting any newspaper drop or other recycling drive. Weight receipts from all sales of designated recyclable materials, whether by the Township or a duly authorized volunteer or charitable organization, must be submitted to the Recycling Coordinator no later than 30 days after the collection.
The Recycling Coordinator is hereby authorized and directed to establish and promulgate reasonable regulations as to the manner, days and times for the collection of designated recyclable materials in accordance with the terms hereof. The governing body may change, modify, repeal or amend any portion of the rules and regulations.
The Construction Official shall inform the Township Recycling Office upon issuance of a certificate of occupancy on any property located in the Township so that the new owner/tenant will be informed of the regulations.
A. 
This article shall be enforced by the Police Department, the Department of Public Works, the Department of Health, the Construction Code Official, the Recycling Coordinator, the County Health Department or its designee, and such other duly designated agents as may be authorized by resolution of the governing body.
B. 
The designated enforcement agents are authorized and directed to enforce all provisions of this article, including inspections and penalties for noncompliance. The designated enforcement agents shall make inspections of solid waste and/or recyclables on a random basis at least once per month per collection route to determine any noncompliance with this article.

Where the governing body by ordinance or resolution so determines, fees shall be payable for the collection and disposal of recyclable materials as set forth in Chapter 71, Fees. Fees shall be charged for the following:
A. 
Collection and disposal of tires.
B. 
Metal scrap and appliances.
(1) 
Collection and disposal of metal scrap and appliances when picked up at curbside.
(2) 
Any items containing Freon, whether picked up or brought to the recycling center.
C. 
Landscapers depositing vegetative waste at the Department of Public Works for disposal, whether or not trucks are filled to capacity.
A. 
Any person who violates § 214-4B by collecting or picking up or causing to be picked up any designated recyclable material, upon conviction thereof, shall be liable to a fine not less than $100 or more than $1,000 per offense. Any person who violates § 214-4C or D by failing to collect, pickup or cause to be picked up any designated recyclable material in the manner specified, or by failing to fulfill the requirements for registration or documentation in the manner specified, upon conviction thereof, shall be liable to a fine not less than $100 or more than $1,000.
B. 
Any unlawful dumping of recyclable materials at the Little Falls Recycling Center or anywhere within the jurisdiction of the Township shall be punishable by a fine not less than $100 or more than $1,000 or no more than 90 days in jail, or both, for each and every offense.
C. 
Any person who violates any of the other terms of this article shall be liable to a fine not to exceed $100 per offense. The governing body may by resolution require that the Township's scavenger inspect trash for the presence of designated recyclable materials. If designated recyclable materials are found, the scavenger shall be authorized to leave same at curbside and place a warning sticker on the container, and the person shall be responsible for separating the recyclables before the next collection date.
D. 
Any person who violates any of the provisions of § 214-4E shall be liable to a fine not less than $100 nor more than $1,000 per offense.
E. 
No provision of this article shall be construed to impair any common law or statutory cause of action or any other legal remedy, including but not limited to any other penalties provided by the ordinances of the Township for any violation(s) thereof.
