It is hereby determined by the Board of Trustees
of the Village of East Rockaway that the best interests of the people
of East Rockaway will be promoted in the event that all legal notices
relating to the Village of East Rockaway are published in a newspaper
or newspapers circulated in the Village of East Rockaway, and the
Board of Trustees has the freedom of choice with respect to the designation
of a newspaper or newspapers for such publication.
Notwithstanding any provisions of the Village
Law to the contrary, and particularly notwithstanding the provisions
of Subdivision 8 of § 89 of the Village Law, as last amended
by Chapter 946 of the Laws of 1964,[1] the official newspaper of the Village of East Rockaway
shall be designated as hereinafter provided.

As currently stated, § 4-412 does not include the official
newspaper provisions previously offered by Subsection 8 of § 89.
The Board of Trustees of the Village of East
Rockaway may designate a newspaper as the official paper of the Village.
If but one newspaper is circulated in the Village continuously, it
shall be designated as the official paper of the Village. In the event
two or more newspapers are circulated in the Village continuously,
any one of such papers may be designated as the official newspaper,
if any paper is so designated. If no official paper has been designated,
the designation of a newspaper for the publication of a notice, resolution,
ordinance or other proceeding of the Board shall be deemed a designation
thereof as the official paper of the Village for the purpose of such
publication. Additional newspapers may be designated for the publication
of Village notices at the option of the Village Board.
