The following rules and regulations shall apply to all waters or waterways within or adjacent to the Village of East Rockaway, for a distance of 1,500 feet from the shoreline and subject to its jurisdiction, except when prohibited by the laws of the United States.
All provisions of the Navigation Law of this state, of the inland rules enacted by Congress and governing the navigation of the inland waters of the United States and of the Pilot Rules for United States Inland Waters, applicable to the channel systems relative to the rules for vessels passing each other, as to lights on vessels and other matters consistent with the proper use of the channel systems, shall be complied with by all vessels navigating said systems.

As used in this Article, the following terms shall have the meanings indicated:
BOAT or VESSEL and OTHER WATERCRAFT
Includes every description of watercraft or other contrivance used on or capable of being used as a means of transportation or otherwise in water.
CHANNEL SYSTEMS
Main channels, cross channels connecting with them, basins and bathing areas.
OWNER
Includes the person or firm whose name the vessel or watercraft was last registered with the United States Coast Guard or the New York State Department of Public Works or, in any other case, the last known owner.
The discharging of toilets is prohibited in areas designed as basin, dock or bathing areas.

A. 
Boats, as defined herein, shall not moor or anchor in any channel except at the edges thereof, and in no case shall boats or vessels, as hereinbefore defined, moor or anchor so as to interfere with the full use of the channel. Any vessel, boat or other watercraft which becomes a menace to navigation, or unseaworthy or sinks, grounds or becomes otherwise disabled, shall be removed by the owner or person in charge thereof on order of the Village Board of the Village of East Rockaway or any duly authorized officer of or agent of said Village. If said boat or watercraft is not removed after orders to so remove it, it may be removed by or at the direction of the Village Board of the Village of East Rockaway or any duly authorized officer or agent thereof, at the expense of the owner or person in charge of said vessel or craft.
B. 
Boats and other watercraft as defined herein shall not moor or anchor so as to endanger the safety of, or cause damage to, any boat previously anchored or moored nor so as to interfere with the mooring of any boat previously laid down. Any boats or vessels, as herein defined, so moored or anchored shall be removed by the owner or person in charge thereof on order of the Village Board of the Village of East Rockaway or any duly authorized officer or agent thereof. If said vessel or boat is not removed after orders to so remove it, it may be removed by or at the direction of said Village Board of the Village of East Rockaway, or any duly authorized officer or agent thereof at the expense of the owner or person in charge of the said vessel, boat or watercraft.
Every person operating a boat, vessel or watercraft, as herein defined, shall at all times operate the same in a careful and prudent manner and at such a rate of speed as not to disturb the reasonable comfort or endanger the property of another or the life or limb of any person, or so as to interfere with the free use, as well as the proper use, of the waters of the channel. Throwing up a wake which is dangerous to life or limb of persons, boats or other property is also prohibited by this Article.
A. 
No vessel, boat or other watercraft, as herein defined, shall be moored or anchored in any waterway as defined in § 96-32 of this Article, so that such vessel, boat or watercraft, or any part or projection thereof, extends into the waterway more than 1/4 of the width of such waterway, as measured between the mean low-water lines along the waterway at the point or place that such vessel, boat or watercraft is moored or anchored.
B. 
Subsection A above shall apply only to such points or places along the waterways as defined in § 96-32 of this Article, wherein said waterway is less than 100 feet in width as measured from the mean high-water line at the point or place to the closest point or place along the mean high-water line of the opposite bank, shore or bulkhead.
C. 
At such points or places along the waterways as defined in § 96-32 hereof that slips or basins have been cut or excavated into the adjacent upland, the computations of distances between mean low-water lines and mean high-water lines shall be made from the extensions of the mean low-water lines and mean high-water lines in front of the uplands immediately adjoining and adjacent to the slip or basin.
No owner and/or person in charge of any boat, vessel or watercraft as herein defined shall, while moored, anchored or otherwise, within said waterways as defined in § 96-32 hereof, permit or authorize an occupant or occupants thereof to so conduct himself or themselves in such a noisy and/or disorderly manner that a breach of the public peace is thereby created.

A. 
No boat shall be operated at a greater speed than 12 miles per hour in channels nor at a greater speed than four miles per hour in areas designated as a boat basin, anchorage, bathing area or any such areas, in which speed limit signs are posted, except where permission is granted by the Village Board of the Village of East Rockaway pursuant to § 96-42 hereof. The term "speed" shall mean the speed of a boat as measured in slack water in statute miles.
B. 
No boat shall be operated at a greater speed than four miles per hour in that waterway known and designated as the "Edward A. Talfor Memorial Boat Basin."
Water skiing, aquaplaning or similar sports are hereby prohibited in any speed zone of four miles per hour and in any areas designated as a boat basin, anchorage or bathing area, without the written consent of the Village Board of the Village of East Rockaway.

No person shall operate a boat propelled wholly or partly by an engine operated by gas, gasoline, naphtha, diesel oil or other substance without having the exhaust from the engine run through a muffler or so controlled by the introduction of water into the exhaust pipe or line so as to muffle the noise of exhaust in a reasonable manner.
The racing of power driven boats of any type is prohibited unless written permission shall have been received from the Village Board of the Village of East Rockaway. The application therefor shall state the time and place of the proposed race or races, the types of boats participating therein and the type and kind of race to be conducted.
The Police Department of the County of Nassau is hereby empowered to enforce the provisions of this Article, and every person in charge of the vessel, boat or watercraft navigating or using the waterways as defined in § 96-32 hereof, shall at all times obey the lawful orders of the members of the Police Department. Such Department shall have the right to stop any vessel, boat or watercraft navigating or using the waterways defined in § 96-32 of this Article, for the purposes of enforcing this Article.

Any person committing an offense against any provision of this Article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this Article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
