No person or persons, firm, association or corporation owning, leasing, managing, conducting or operating any establishment within the village wherein food or drink is sold or given away or offered for sale on a daily, weekly or monthly basis shall permit or suffer any dancing, cabaret show or other exhibition, amusement, performance or entertainment therein without first procuring a license for such dancing, cabaret show or other exhibition, amusement, performance or entertainment. Nor shall any person or persons, firm, association or corporation owning, leasing, managing, conducting or operating any theater, dance hall or place of amusement in the village permit any dancing, cabaret show or other exhibition or performance therein without first procuring a license therefor.
Any applicant for such license shall apply in writing to the Board of Trustees for the issuance of a license. The application for such license shall state in detail the nature of the dancing, cabaret show or other exhibition, amusement, performance or entertainment for which a license is desired, the location of the building wherein the same is to be conducted or permitted, together with a survey showing the parking space available for the off-street parking of cars. The application shall state the size of the building, the number of people to be accommodated, the number of exits and the name of the person or persons, firm, association or corporation which desires to conduct such dance, cabaret show or other exhibition, amusement, performance or entertainment. Said application must specify the residence of the persons comprising any such firm, association or corporation and the particular place of business of any such corporation and the name of the officer, in the case of a corporation, upon whom process or other legal notice may be served within the village.
For permission to carry on a regular business of presenting dances, cabaret shows and other exhibitions and performances, an annual license fee of $100 shall be paid, except that in the case of a bona fide restaurant the annual license fee shall be $25. If the application shall be for the temporary use of premises for such purposes as outlined in this chapter, the license fee shall be $10 for each day during which the premises are so to be used, payable in advance thereof.

Any person, association, firm or corporation which violates any provision of this chapter or assists in the violation of any provision of this chapter shall be guilty of a violation punishable by a fine not exceeding $1,000 or imprisonment for a period not to exceed 15 days, or both, for conviction of a first offense; for conviction of a second offense, both of which were committed within a period of five years, punishable by a fine of not less than $1,000 nor more than $2,000 or imprisonment for a period not to exceed 15 days, or both; and upon conviction of a third or subsequent offense, all of which were committed within a period of five years, punishable by a fine of not less than $2,000 nor more than $3,000 or imprisonment for a period not to exceed 15 days, or both. Each week's continued violation shall constitute a separate additional violation.
