A. 
No regulated earth disturbance activities within the Township, unless exempt under criteria listed in § 172-6, shall proceed until approval by the Township Engineer of a BMP operations and maintenance plan, which describes how the permanent (e.g., postconstruction) stormwater BMPs will be properly operated and maintained and contains all stormwater management facilities and the design computations.
B. 
Permit application.
(1) 
Every applicant for an earth disturbance permit shall file a written application therefore with the Manager.
(2) 
The application shall show or be accompanied by:
(a) 
Three copies of the BMP operations and maintenance plan.
(b) 
A narrative prepared by a registered professional engineer or other professional qualified in hydrology.
(c) 
The applicable fee, as adopted by resolution of the Board of Supervisors.
C. 
BMP operations and maintenance plan.
(1) 
Map(s) of the project area shall be submitted on fifteen-inch by eighteen-inch, eighteen-inch by thirty-inch or twenty-four-inch by thirty-six-inch sheets in a form that meets the requirements for recording at the offices of the Recorder of Deeds of Montgomery County.
(2) 
The BMP operations and maintenance plan shall consist of:
(a) 
A grading plan.
(b) 
A drainage and sedimentation control plan.
(c) 
A landscaping plan.
(d) 
A narrative.
(3) 
The following items shall be included in the grading plan:
(a) 
The name and address of the owner/applicant.
(b) 
The lot or tax parcel number or street address of the site.
(c) 
The name, address and seal of the registered professional engineer responsible for the preparation of the plan.
(d) 
The location map showing relation of the site to adjoining properties and streets.
(e) 
The North point.
(f) 
Written and graphic scales.
(g) 
A complete outline survey of the affected property showing all courses, distances, area and names of landowners of adjoining properties.
(h) 
Natural features within the subject site or within 50 feet of any boundary of the site.
[1] 
Existing contour lines measured at vertical intervals of two feet.
[2] 
Types, depth and areal extent of predominant soils on the property.
[3] 
Underlying geologic formations.
[4] 
Floodplain areas.
[5] 
Steep slope areas.
[a] 
Fifteen percent to 25%.
[b] 
Twenty-five percent and over.
[6] 
Forest areas.
[7] 
Lakes and ponds.
[8] 
Wetlands.
(i) 
The locations of all existing utilities, sanitary sewers and water lines within 50 feet of any boundary of the site.
(j) 
Proposed development.
[1] 
Delineation of the limits of work and the areas to remain undisturbed.
[2] 
Plan of the proposed finished contours at vertical intervals of two feet.
[3] 
Areas of cuts and areas of fill.
[4] 
Alterations to land surface and vegetative cover, including size and location of structures, roads, paved areas and other impervious surfaces.
[5] 
Location of proposed utilities, sanitary sewers and water lines.
[6] 
Location and nature of permanent stormwater management facilities.
(4) 
The following items shall be included in the landscaping plan, on a separate sheet, superimposed upon the grading plan:
(a) 
The name, address and seal of the registered landscape architect responsible for the preparation of the plan.
(b) 
Existing vegetative cover, including:
[1] 
Meadow areas.
[2] 
Lawn areas.
[3] 
Woodland areas.
[4] 
Agricultural areas, row crops.
(c) 
Woodland areas within 50 feet of any earth disturbance activity proposed to be preserved, including:
[1] 
Trunk locations.
[2] 
Dripline locations.
[3] 
Tree protection zones.
(d) 
All proposed landscape and vegetative BMP measures.
(e) 
A proposed planting schedule indicating the locations, species and sizes of plantings and seedings as may be required.
(f) 
Maintenance requirements for plantings and seedings.
(g) 
Locations and construction details of proposed retaining walls.
(h) 
Any special soil and fill mediums, if applicable.
(5) 
The following items shall be included in the drainage and sedimentation plan, on a separate sheet, superimposed upon the grading plan:
(a) 
A mapping of the watershed area or areas in which the site is located (United States Coast and Geological Survey Quadrangle Map or similar) with predevelopment and post-development areas outlined.
(b) 
The calculated runoffs from a the one- through one-hundred-year-frequency storms, in cubic feet per second, to all existing and proposed drainage structures and watercourses, based upon the computational method best suited to the watershed size of the project site.
(c) 
A plan of the proposed stormwater drainage systems, including storm drainpipes and inlets, runoff control devices, drainage channels, swales, structures, detention basins and other stormwater management facilities and BMPs. All existing drainage features which are to be incorporated in the design shall be so identified with an explanation of the operations of the facilities. The drainage areas into each inlet or structure must be delineated on the plan of the stormwater drainage system.
(d) 
Detailed designs for berm embankments, outlet structures and any appurtenances related to temporary basins and all stormwater and erosion and sedimentation control facilities, including but not limited to:
[1] 
The slope of the berm embankment.
[2] 
The top elevation and width of the berm embankment.
[3] 
The embankment side slopes.
[4] 
The emergency spillway elevation.
[5] 
The elevations of the outlet structure, including the riser.
[6] 
Dimensions and spacings of risers, pipe barrels and antiseep collars.
(e) 
The proposed location of utilities and easements.
(6) 
The following information shall be included in the narrative:
(a) 
A general description of the proposed development.
(b) 
A general description of temporary and permanent accelerated erosion control.
(c) 
A general description of temporary and permanent sedimentation control.
(d) 
A general description of stormwater management both during and after development.
(e) 
A study of the watershed in which the site is located to assess the impact the proposal will have on downstream conditions.
(f) 
Computations of the stormwater runoff for all points of runoff concentration before and after development, including:
[1] 
The design computations for the stormwater drainage systems, including storm drain pipes and inlets, runoff control measures and culverts and drainage channels.
[2] 
Computations of the stormwater runoff before, during and after construction, including all supporting material.
[3] 
The flood routing and/or storage requirement calculations.
(g) 
The estimated development schedule for the site, including:
[1] 
Stripping and/or clearing.
[2] 
Rough grading and installation of erosion and sediment control facilities and practices.
[3] 
Installation of improvements, including streets, underground utilities, buildings, driveways, parking areas and other structures and facilities.
[4] 
Final grading and vegetative establishment, including program of operations for conversion of erosion and sediment controls to permanent stormwater management facilities.
(h) 
A map and statement describing temporary control measures and facilities for use during earthmoving.
[1] 
Types, locations and dimensional details of erosion and sedimentation control.
[2] 
Protection of existing trees and shrubs.
[3] 
Facilities to prevent tracking of mud by construction vehicles off the site.
(i) 
A permanent stormwater management program.
[1] 
A statement regarding conformance with requirements of this chapter, including BMPs.
[2] 
Types, locations, dimensioned details and specifications of stormwater management facilities and BMPs, including:
[a] 
Detailed plans of the trash rack and anti-vortex device.
[b] 
Detailed plans of all required off-site improvements.
[3] 
Design considerations and calculations supporting the stormwater management program, including:
[a] 
A stage-storage curve for all detention/retention basins.
[b] 
Computations for the sizing of the pipe barrel and perforated riser.
[4] 
Establishment of permanent vegetation or other soil stabilization measures, including:
[a] 
All landscape and vegetative BMP measures.
[b] 
Seeding mixes and rates.
[c] 
Mowing rates, if applicable.
[5] 
The location of wells and septic tank leach fields.
[6] 
The location and legal descriptions of rights-of-way, easements or lands offered for dedication related to the management of stormwater.
(j) 
Maintenance procedures and ownership arrangements for temporary and permanent stormwater management facilities, including BMPs.
[1] 
Methods and frequency of removing and disposing of sediment and other materials from stormwater management facilities both during and upon completion of the project.
[2] 
Proposed ownership and financial responsibility for permanent stormwater management facilities, including BMPs.
[3] 
Operating and maintenance arrangements for permanent stormwater management facilities and BMPs, including the identity of the person(s) responsible for such operations and maintenance.
(k) 
A statement, signed by the landowner, acknowledging that the stormwater management facilities and BMPs are fixtures that can be altered or removed only after approval by the Township.
A. 
General.
(1) 
The BMP operations and maintenance plan and all information and procedures related thereto shall in all respects be in compliance with the provisions of this chapter, except where variation there from may be authorized by the Township Engineer pursuant to § 172-6B.
(2) 
Deposits and fees. Deposits and fees for BMP operations and maintenance plans are listed in the Skippack Township fee schedule. The Township shall collect and immediately deposit all township fees in the proper township bank account, as directed by the Board of Supervisors.
B. 
Procedures.
(1) 
The applicant shall prepare the BMP operations and maintenance plan and application form, including the data specified in § 172-16.
(2) 
The applicant shall prepare permit applications for any activities that require a DEP joint permit application regulated under Chapter 105 (Dam Safety and Waterway Management) or Chapter 106 (Floodplain Management) of DEP's Rules and Regulations, require a PA DOT highway occupancy permit or any other permit required under applicable state or federal regulations.
(3) 
The applicant shall submit to the Manager:
(a) 
Three copies of the BMP operations and maintenance plan, except as required in the Subdivision and Land Development Ordinance[1] for preliminary or final subdivision and land development plans.

(b) 
A Skippack Township BMP operations and maintenance plan application.
(c) 
All applicable fees.
(4) 
The Manager shall check the submission for completeness. No application shall be deemed complete unless and until all items in Subsection B(3)(a) through (c) hereinabove have been submitted. If the submission is incomplete, the Township Engineer shall notify the applicant within seven days and indicate the deficiencies. If the application is complete, the Township Engineer shall accept the BMP operations and maintenance plan, application form and fees.
(5) 
The Manager shall immediately distribute one copy of the BMP operations and maintenance plan and application form to the Township Engineer. Two copies shall be retained by the Manager.
(6) 
The Township Engineer should, within 30 days following acceptance of the BMP operations and maintenance plan application:
(a) 
Review the engineering considerations in the applicant's submission.
(b) 
Make recommendations to the Board of Supervisors.
(7) 
The Board of Supervisors should, within 75 days, and shall within 90 days following acceptance of the BMP operations and maintenance plan application:
(a) 
Review the report of the Township Engineer and, where applicable, the Township Planner.
(b) 
Determine whether the BMP operations and maintenance plan meets the objectives and requirements of this chapter and other pertinent regulations and ordinances.
(c) 
Approve or disapprove the BMP operations and maintenance plan. If disapproved, the Board of Supervisors shall state the reasons for this action.
(8) 
The decision of the Board of Supervisors and any conditions imposed by the Board of Supervisors shall be in writing and shall be communicated to the applicant or his agent personally or mailed to him or her at the last known address not later than 15 days following the decision. Approval shall be rescinded automatically upon the applicant's or applicant's agent's failure to accept or reject any conditions imposed by the Board of Supervisors within seven days of receipt of the written decision.
(9) 
If the BMP operations and maintenance plan is approved:
(a) 
The Board of Supervisors shall adopt a resolution approving the BMP operations and maintenance plan.
(b) 
Approval shall not be final until entry into contract and production of a completion guaranty as set forth in § 172-29.
(c) 
Two linen copies and three paper copies of the record plan shall be submitted to the Manager.
(d) 
The record plan shall be a clear and legible blue- or black-line print and shall be an exact copy of the approved plan on a sheet of the size required by the office of the Montgomery County Recorder of Deeds. The following signatures, seals and acknowledgments shall appear on the record plan in addition to the information required in § 172-16:
[1] 
The signature and impressed seal of the engineer who prepared the plan.
[2] 
The signatures of the owner or owners of the land. If the owner of the land is a corporation, the signatures of the president and secretary of the corporation shall appear.
[3] 
The impressed corporate seal, if the applicant is a corporation.
[4] 
The signature and impressed seal of a notary public or other qualified officer acknowledging a statement that the applicant is the owner of the land proposed to be improved with stormwater management facilities and that the facilities shown on the plan are made with his, her or their free consent and that it is desired to record the same.
[5] 
The signature and impressed seal of the Township Engineer.
[6] 
The signatures of the President and Secretary of the Board of Supervisors and the impressed seal of Skippack Township.
(10) 
If the BMP operations and maintenance plan is disapproved, the applicant may file a revised plan with the Manager in order to secure approval. No fee will be charged for the first revision, but all successive submissions shall pay a new fee and shall replenish the escrow deposit to its original amount.
A. 
The owner of any land upon which permanent BMPs will be placed, constructed or implemented, as described in the BMP operations and maintenance plan, shall record the following documents in the office of the Recorder of Deeds for Montgomery County:
(1) 
The record plan;
(2) 
Operations and maintenance agreements under § 172-26; and
(3) 
Easements under § 172-27.
B. 
The Township shall not release the record plan and supporting documents unless and until all conditions of approval have been satisfied. The owner shall record the record plan and supporting documents within 15 days of release by the Township.
C. 
The Township may suspend or revoke any approvals granted for the project site upon discovery of the failure of the owner to comply with this section.
A. 
If stormwater facilities and BMPs are accepted by the Township for dedication, the Township shall require persons installing stormwater BMPs to pay a specified amount to the Township Stormwater BMP Operation and Maintenance Fund, to help defray costs of operations and maintenance activities. The amount may be determined as follows:
(1) 
If the stormwater facility or BMP is to be owned and maintained by the Township, the amount shall cover the estimated costs for operations and maintenance for 10 years as determined by the Township.
(2) 
The amount shall then be converted to present worth of the annual series values.
B. 
If a BMP is proposed that also serves as a recreation facility (e.g., ball field, lake), the Township may adjust the amount accordingly.
A. 
It shall be unlawful to alter or remove any permanent stormwater BMP required by an approved BMP operations and maintenance plan or to allow the property to remain in a condition which does not conform to an approved BMP operations and maintenance plan unless an exception is granted in writing by the Township. A note shall be placed on the plan stating this requirement.
B. 
A copy of the BMP operations and maintenance plan and narrative shall be made part of the residential disclosure statement and purchase agreement for any lot affected by the facilities.
