Every individual, partnership, firm or corporation
collecting solid waste within the boundaries of the township shall
dump all such solid waste collected within the boundaries of the township
at designated disposal sites existing and operating in accordance
with the rules and regulations of the PaDEP.
Every individual, partnership, firm or corporation
collecting and hauling solid waste or recyclable materials for commercial
properties, and institutional and municipal establishments, shall
obtain a permit from the township.
All permits shall be issued for a period of
one year commencing on July 1 and ending on June 30. Such permits
are not transferable.

All persons collecting solid waste or recyclable
materials in the township shall pay a fee as set forth from time to
time by resolution of the Board of Supervisors for the use of one
truck and a fee as set forth from time to time by resolution of the
Board of Supervisors for each additional truck, annually, for a permit
enabling them to operate within the township.
The direction, supervision and control of the
solid waste and recycling program shall be by the Township Manager
or his agent. The Township Manager or his agent shall generally supervise
the collection and disposal of solid waste in the township. The West
Hanover Township Environmental Advisory Committee shall act in an
advisory capacity to the Township Manager and the Board of Supervisors.
Hazardous waste, as defined by the United States
Environmental Protection Agency and the PaDEP, shall not be dumped
or disposed at any designated disposal site.
Any person, association, partnership or corporation
who fails to comply with any of the requirements or provisions of
this article or any regulations issued pursuant to this article or
who fails or refuses to comply with any notice, order or direction
of any officer or employee of the township given pursuant to the authority
conferred herein shall be guilty of a summary offense and, upon conviction
thereof before any District Justice, shall be sentenced to pay a fine
of not less than $100 nor more than $600 and costs of prosecution
for each and every offense, and, in default of payment thereof, shall
be imprisoned in the county jail for not more than 30 days.
