No person shall place any commercial advertising material upon any public property or in any street, alley or public grounds or upon any private property situated and fixed in any street, alley or public ground.
No person shall place any commercial advertising material upon any private property without first having obtained a permit from the Clerk-Treasurer. An application for such permit shall be filed with the Clerk-Treasurer and shall specify the full name, address and telephone number of the applicant and such other information as the Clerk-Treasurer may reasonably require concerning the applicant and employees. Upon receipt of an application fee as set by the Village Board, the Clerk-Treasurer shall cause issuance of a permit in the name of the applicant. No permit shall be transferable. All permits granted hereunder shall expire on the 30th day of June following the date of their issuance unless sooner revoked. Permits may be temporarily suspended by the Clerk-Treasurer upon violation by the holder of any of the provisions of this chapter, provided that such suspension shall not exceed 30 days. Permits may be revoked, after an opportunity for hearing by the Police and Fire Committee, upon willful, intentional, continuous or repeated violations of the provisions of this chapter.
No person shall place any commercial advertising material upon any private property except in compliance with the following:
A. 
Any plastic bag used in distribution shall be a minimum of one millimeter in thickness and shall have a minimum of 20 holes, each at least 1/4 inch in diameter.
B. 
No toxic material or material injurious to health shall be distributed.
C. 
All unclaimed material shall be collected by the distributor or his agent by 6:00 p.m. on the day following the day of distribution.
D. 
No distribution of such material shall be made to any private dwelling if the owner or occupant thereof gives notice in any reasonable manner that he does not wish to receive such material.
E. 
Every distribution of commercial advertising material shall include the name, address and telephone number of the person responsible for such distribution.
This chapter shall not apply to the posting of notices required by law nor to materials distributed through the United States mail.
Any person who shall violate any provision of this chapter shall be subject to a penalty as provided in § 1-4 of this Municipal Code.
